Cruz and Rubio Eligibility Lawsuit Set for 11 AM, Friday March 4th in Florida
Gateway Pundit ^ | 02/29/16 | Jim Hoft

Although Florida media reported that Senator Marco Rubio’s parents were not US citizens when he was born, national media has largely avoided the topic.   Senator Ted Cruz’s status as a natural born Canadian and a number of related eligibility lawsuits were underreported nationally, until news hit that an IL judge was hearing one of the cases.

Cruz’s lawsuits were filed in Florida, Vermont, Texas, Utah, Illinois, Arkansas, Alabama, New York, and Pennsylvania, and individuals who raised a ballot challenge in Indiana are weighing whether they’ll file suit.

Cruz has a new IL court date March 1st – Super Tuesday, a filing deadline on March 2nd for the AR case after his requested extension was granted, and a joint court date with one Senator Marco Rubio on March 4th in Rubio’s home state of Florida. Rubio’s pending lawsuits, court dates, and questionable defenses to the actions have been missing from the national discussion.

The initial narrative had Rubio’s parents fleeing Cuba’s Castro in 1959.   It was later revealed they’d arrived in America in 1956 instead.   Rubio’s parents did not become US citizens until nearly twenty years later, several years after Rubio’s 1971 birth.   Their status as Cuban citizens, not US citizens, at the time of Marco’s birth prompted his inclusion in the Florida, Vermont, Arkansas and Indiana suits and challenges above.

Thomas Lee, a professor of constitutional and international law at Fordham Law School, explained a portion of the Originalist view of natural born citizenship, namely jus soli and jus sanguinis. As Mario Apuzzo elucidates:

I think Cruz and Rubio are done for this cycle but they are young guys who will be at it in the future.

It would be good to get this resolved this year, if that is possible.

It is time for Rubio and Cruz to leave the race for the good of the country

I’m sorry it hurts so many feelings that natural born citizen is an exclusionary term meaning one can only be a US citizen and nothing else, born here of citizen parents.
Naturally a US citizen because there is no other possibility.

Barry Soetoro/Barack Hussein Obama should be proof enough of the wisdom of the founders when they tried to prevent him from being President by requiring someone who could only be a US citizen and nothing else.
Born here of citizen parents.
Naturally a US citizen because there is no other possibility.
One cannot be anything else and also be a natural born citizen.

Obama told us he was born a British Subject.

Who believes Washington, Jefferson, Adams, Jay, Monroe, Madison, etc. would have found him to be a natural born citizen?

Rubio and Cruz think they should get away with it because Barry Soetoro/Barack Hussein Obama got away with it.

Usurpation Day, January 20, 2009, happened with the complete cooperation of both parties.
They want the Constitution changed without the hassle of amending the Constitution.
Confuse people about the clear meaning of a three word phrase and voila, every anchor baby and Winston Chrurchill is eligible.

The bench was the reason the GOP went along with the fig leaf resolution for McCain as cover for Obama.
Jindal, Rubio, Haley and Cruz were all up and comers and the future of the party and ineligible.

So, if the courts find them eligible to be president, will any of you let this go?
I think not.

"It would be good to get this resolved this year, if that is possible."

It should be resolved this year. Rubio is not a Natural Born citizen. Read the Constitution. Any judge should easily be able to rule against Rubio's eligibility. Of course one has to assume that the judge understands the English language. That could be a problem considering the recent SCOTUS rulings.

It’s called the law... We are either a nation of laws or we are not. It’s just that simple.

Whatever Obama’s citizenship at birth, his loyalty became divided when he took on Indonesian citizenship during his growing up years.

The founders didn’t recognize dual citizenship.

What kind of cluster would it be to have different findings in different states? Sheesh..could get messy.

There are 3 simple critical criteria to be NBC: 2 citizen parents and born on US soil.

Obama - 1 citizen parent, born on US soil (2 out of 3)

Cruz - 1 citizen parent, not born on US soil (1 out of 3)

Rubio - No citizen parents, born on US soil (1 out of 3)

We no longer live in a country of laws but of men who prefer word salad and bending the law to suit themselves.

Demonstratively incorrect.

I won't. I took an oath to support and defend the Constitution of the United States against all enemies foreign and domestic. That is an oath for life. Yes, I do read, write, (fairly well) and understand the English language.

Although I’ve been a Cruz supporter from the beginning, this is an issue that I would really like to see resolved, but it’s not going to be. Even if a state judge decides against Cruz or Rubio, it will be appealed and a federal judge will likely enjoin the decision and a long-term legal battle culminating in the Supreme Court will be the result.

What troubles me about this is that not nearly as big a deal was made about Obama’s status and it’s been hanging over our heads for over seven years.

We're not. Maybe we will be again, but I'm not feeling too optimistic these days.

Thank you. Both my husbands, my son and my step-son took the same oath. I consider that I did by virtue of 20 years as a dependent.

We will never consider them eligible.

To support his claim Cruz cites the opinion of Clement & Katyal rather than law.
