I've wondered whether Scalia was offered it and declined. Perhaps we'll never know.
With a 4-4 USSC appeals court decisions will all stand and the opportunity to rush up a bunch of cases through friendly courts to overturn things like the 1st and 2nd Amendments, at least in the jurisdictions of those lower courts should occasion some alarm.

Thomas choosing to ask question rather than just listen must be related to Scalia’s absence.
Could he be signaling “I am not intimidated!”?
I think it's too early to conclude this. AJ Thomas has previously been very interested in 2nd Amendment cases, it's obviously an issue he cares deeply about,

And the GOP? Congress *COULD* step in a say a thing or two. Course, they’re of the same cloth that the SCOTUS is sacra-sanct and the end-all (no, that’s We the People).
Just think of the problems of judicial activism that could have been thwarted if they lifted a single idea of, “We WILL cut you off...”.
I thought there was a movie script in progress or hiring of actors, or maybe they’re already in production; but ever since Scalia passed, it’s been silence.
However, with Justice Thomas becoming more vocal, I’m wondering if the movie project has geared up .. just to see if they can smear Thomas one more time.
I see an invitation to a TX ranch in his future.
My guess is Scalia would ask every question Thomas would ask, so Thomas didn’t need to ask anything.
I can’t think it is a coincidence.
Of course, who knows for sure except Thomas.
I think it’s great. Liberals used to make fun and demean Thomas for not saying anything.

That statement gave me chills....you are correct. Of all the people in the world I have said I wanted to meet....Justice Thomas has been the top one.
