Trump supporters file 'birther' lawsuit against Cruz in federal court

Donald Trump supporters have filed a lawsuit challenging the eligibility of one of his primary rivals, Sen. Ted Cruz (R-Texas), to run for president.

The lawsuit, filed Feb. 3 at a district court in Alabama, seeks a judgment "declaring that Rafael Edward Cruz is ineligible to qualify/run/seek and be elected to the Office of the President of the United States of America" due to his Canadian birth. Cruz was born in Calgary, Canada, to an American mother.

The five plaintiffs — Sebastian Green, Shannon Duncan, Kathryn Spears, Kyle Spears and Jerry Parker — are all backing Trump in the Republican primary, according to AL.com.

I have been a Cruz supporter that was not against Trump. I have not read any comments on this thread yet. But if Trump supporters rabidly are pushing this, I’ll be turned off.

He's released all the records necessary to decide the case.

Plus, vital records and CRBA-like (citizenship) records are not public by default. You don't have to take action to have YOUR birth certificate "sealed," that's it's normal condition.

What Cruz is doing, is arguing to courts that they should NOT decide the case.

I was thinking the same thing.

Cruz may be the winner here. A judge says he is eligible and that is the end of that.

To have standing, you have to be able to articulate an injury that you will suffer that is distinct from a generalized claim of injury to the public at large. In other words, you have to be able to show how you are injured in a way that is different from the general public.

Wouldn't that then imply that no individual has standing?

The court should take the case whether there is standing or not ... we need to know legally if this is really an issue. For every lawyer out there saying its not an issue, there is another one that says he is not eligible. The court must rule here.

Naturalization does not ever create a Natural Born Citizen. At best all Congress has the power to do is Naturalize citizens from birth without requiring any process for them to become Naturalized Citizens.

As for the rest of it...spot on.

You and almost everyone else know that this is an area that is open to interpretation and has no actual precedence. Would you argue that a child born in Iran to an American mother held against her will with an Iranian prison guard father and raised by the father is a “natural born citizen” of the United States? Keep in mind that Ted’s dad claims that he fought alongside Castro in the Revolution for several years before he realized that Castro was a Communist. I guess all those Commie Castro posters took awhile to sink in?

Trump has his own issues if he really has British citizenship himself.

Impossible, he was born to two American Citizens on Americans soil. Happerstt vs Minor said there is no doubt that is what a NBC is....but there are doubts to others.

I have standing. Last Monday the California Secretary of State placed my name on the June 7th presidential primary ballot of the American Independent Party.

Some are trying to convince me that I should bring suit, not just against Cruz, but also against Rubio, but I’m not sure if that’s the way to go. Still praying and thinking about it.
