In what has to be viewed as a major victory for gun owners, the United States Court of Appeals for 4th Circuit ruled that lower court judge in Kolbe V. Maryland must apply the standard of strict scrutiny in reviewing the case about Marylandâs âassault weaponâ ban, duplicitously called the Firearms Safety Act (FSA).
Laws banning âassault weaponsâ in Maryland and in other states with âanti-gunâ legislatures have typically been upheld when lower court judgesâalmost universally gun-hating activist liberalsâhave cheated We, The People by applying the much lower standard of intermediate scrutiny. ...
Chris W. Cox, the executive director of the National Rifle Associationâs Institute for Legislative Action, seems thrilled with the result.
âThe Fourth Circuitâs ruling is an important victory for the Second Amendment. Marylandâs ban on commonly owned firearms and magazines clearly violates our fundamental, individual right to keep and bear arms for self-defense. The highest level of judicial scrutiny should apply when governments try to restrict our Second Amendment freedoms.â

“Texas gun laws are more restrictive than many other states. We are working on it, and I do not want to discourage you from coming, but as far as gun rights, you could do better than Texas.”
I have never seen a ‘non-fully automatic’ gun in an advertisement that I could not buy ‘as is’ in a Texas gun store. I can walk out with it as soon as the paper work is done, no waiting for the Fed’s to do a check since I have a CHL (now a LTC).
From decision to buy to heading to the range is usually less than an hour unless the “Super Gun Salesman” has given another sales pitch...
There are some restrictions on where we can carry, but I personally don’t have any problems with them.
BTW, I am a Benefactor Member of the NRA and a life member of the other major gun groups... I am not a ‘sportsman’ hunter...
Oh. You too, huh?
I did not know that, thanks for the info. I visited Maine once, back in 1977, beautiful state!
I can remember when I was 14 and my Dad and I walked into a big hardware store, might have been Sears & Roebuck. I had saved a lot of money from my paper route and plunked down $25 plus change on the counter as the clerk handed my Dad the .22 Ithica rifle I had been lusting after. When we got to the car, my Dad handed me the rifle and we drove home with me holding the rifle in the front seat. No paper work, except for a receipt. This was in California in 1964.
Good.
Maryland “Freak State” PING!
I’m not sure that Hogan would want to appeal this ruling.
Truly strict scrutiny would eliminate ALL "gun control" laws, regulations, and rulemaking. The Second Amendment is unambiguous.
But the whole 30.06/07 debate is so stupid. Liberals all over the state are pressuring businesses to restrict those of us that are intent on obeying the law because guns are scary. I think the concealed restrictions should be eliminated entirely, and "proper notice" should never be a liberal, pointing and screeching, "OMG!!! GUUUUUUUUNNNNNNNN!!!!"
Actually, the same bill that allowed Constitutional Carry in Maine also made switch blades legal as well.
Wow, all in one lump...thats great!!
I read an article written last year in the Bangor paper, I think, talking about what the new law means. The comments were hard to figure. Many concealed carry permit holders were against the new law along w/ the state police. The main reason was lack of training requirments. The state police spokesman said he figured it wouldn’t work out well because of that. Itll be interesting to see what things look like in a few years. Im betting its the old blood in the streets argument that near comes true.
I would take anything you read in “The Bangor Daily News” with a grain of salt....to say that news paper leans to the left would be an understatement.
I never heard of any conceal carry permit holders here being opposed to Constitutional carry. As for training, it is always a good idea for a person to take a class to learn the proper handling of a firearm. I’ve seen ads on TV and I’ve heard ads on the radio here in Maine advertising businesses that offer firearm training classes.
As I’m typing this and listening to Rush, I just heard a commercial on the radio for a business called Fox Firearms, which advertised their gun shop and firearm training classes.
Also, the Maine State Police last year came out in favor of Constitutional Carry....they were not opposed to CC.
The Maine State Police said they were too busy to do all the paper work for conceal carry permits, and now they do not have to bother.
Local police chiefs and sheriffs did not support the bill last year, but it passed the democrat-controlled Maine House and the Republican Maine Senate. At first, Gov. Paul LePage hesitated to sign the bill, because it only applied to Maine residents 21 and older. The governor wanted the bill changed to include members of the military between the ages of 18 and 21, and the bill was changed at the governor’s request.
When Arizona recently passed Constitutional Carry, the number of people taking training courses increased. We will see if that happens in Maine.
Maine has a very low crime rate, but recently drug dealers from New York City, Connecticut, Massachusetts and New Jersey have been selling heroin and other drugs in Maine, and buying guns here and bringing them back to their states.
Apparently, a packet of heroin that sells for $15 in New York sells for ten times that amount in Maine. Drug task forces have been created left and right to combat these drug dealers. Meanwhile, Obama pardons the dealers in federal prison.
Thanks for the infos. Sounds like your governor is a good guy!! Ours is much much less so. Will be glad when she’s finally replaced.
We too here in NH have an issue with herion...or so thats what the govt says. The governor is using it as a platform to raise taxes. Hope the legislature has the good sense to tell her to pond sand...well see tho.
Thanks again for the infos about ME.
I hope this helps Colorado dump the stupid magazine limit.
Airsoft?
That picture apparently is, but it was the best image I could find fast that was clear. I’m gonna get a real one. :)
You’ll love it. Double earplugs on the weak side, though.
Agreed, Chris Gibson is gearing up to run for NYS Governor. He needs to run on overturning Cumo's extremist gun act.
