An Obama Administration political appointee who is licensed to practice law in New York has been disbarred after being charged with failing to cooperate with a grievance committee investigation into an allegation that he neglected a potential client.
According to court papers, Tushar Sheth, who was admitted to practice in 2002, became a policy advisor to the U.S. Department of Education in 2013.
That year, Anjhula Bais, who met Sheth in 2011, filed a complaint against him alleging she had approached him about filing a lawsuit but that, after email exchanges and two phone conversations, he "disappeared without a trace."
The grievance committee for the Second, Eleventh and Thirteenth Judicial Departments directed Sheth to file an answer to Bais' complaint, but he failed to do so.
In December 2014, the committee moved to suspend Sheth for failing to submit an answer.
In March, Sheth submitted an affidavit denying he failed to cooperate with the committee's investigation and denied that Bais was his client or had ever paid him a retainer or legal fees.
Sheth included a letter apologizing to Bais and the court, stating that work commitments kept him from following up "the way I should have."
In April, the Appellate Division, Second Department, denied the motion to suspend Sheth but allowed the committee to begin disciplinary proceedings. Sheth failed to file an answer to the committee's petition.
Presiding Justice Randall Eng and Justices William Mastro, Reinaldo Rivera, Mark Dillon and Leonard Austin wrote in Matter of Sheth, 2014-11668, that the charge that Sheth failed to cooperate with the investigation against him was deemed established.

The charges that he failed to cooperate with the investigation. I suspect that what happened is he got disbarred because he simply thought being a member of the regime meant he didn’t have to answer their questions. Had he cooperated I think they would’ve decided the same thing both of you raised

Only way I can see this is if there was a killer deadline, he promised action, didn’t do it, and then wouldn’t answer the phone. That would be a form of verbal contract I suppose, but... prove it?
Not enough facts here obviously, but if J. Doe Grifter can just make a couple of phone calls to a law office and that alone create some attorney - client relationship, that is broken. I have observed that the most grasping, unpleasant and ungrateful clients are the pro bono ones, but this is taking it to a whole new level.
