Obama administration asks Supreme Court to approve executive amnesty

The Justice Department asked the Supreme Court to reinstate President Obama's deportation amnestyFriday, filing papers appealing a federal appeals court's decision blocking the amnesty exactly a year after the program was first announced.

Administration officials hope to get the case on the high court's calendar for this term, which ends in June. Otherwise the case would have to wait to be heard until October 2016, at the earliest, which would mean a decision likely wouldn't come until after Mr. Obama leaves office and a new president has a chance to undo his moves.

Mr. Obama is desperate to try to lock in his policy so his successor will have a tougher time undoing it.

Immigrant-rights advocates cheered the appeal, but said they still want to see more out of Mr. Obama.

"Appealing to defend the expansion of deferred action is the least the Administration can do on immigration," said Marisa Franco, director of the #Not1More Campaign that wants to halt deportations. "The Department of Justice should be investigating the civil rights crisis at DHS that's unfolding with no one watching. ICE's abuses constitute a fire that only the DOJ can put out."

Mr. Obama could have dropped the case and accepted the decision last week from the 5th U.S. Circuit Court of Appeals, which ruled he violated the law. And his decision to appeal didn't sit well with Republicans, who said he had more important priorities to attend to.

"Instead of trying to defend an unconstitutional executive order as he winds down his time in office, the president should work with Congress to secure our borders and improve our immigration laws," said Sen. John Cornyn, Texas Republican.

Something has to be done to counter this supreme court. It is no longer acceptable to allow them the last word as, thanks to people like Orrin Hatch backslapping the likes of Ted Kennedy, they are no longer an impartial arbiter of the Constitution.

Tougher politically maybe, but not legally. It's just an EO. All the new guy needs to undo it is a pen. Doesn't even need a phone.

In fact, I've posted that I think the new guy, whomever it may be, should take a VERY aggressive stance toward BO's EO's. He should state publicly that because it's so well known how badly he abused them, that rather than reviewing them on a case-by-case basis with possible retraction (which gives BO the presumption of validity), that they'd be undone in masse, with a review in case a few were VALID, then they'd be reinstated. That would cause explosions of liberal heads throughout the land, and would actually be better for the public, so it's not just symbolic.

I believe they will refuse.

I don't think the court is into...."Sure...you're breaking the law....you've said it yourself"...and two courts have told you so.

They won't hear it.

And with the papers were pictures, copies of emails, transcribed telephone conversations, etc.

I give it a week before SCOTUS gives Obumagabe anything he wants.

You have to ask yourself how many hundreds of thousands of people Obama has gotten killed and butchered and he keeps on expanding his killing fields.

The democrat party has become the party of death death in the abortion industry that profits handsomely from butchering whole babies, death panels in butcher care (aka Obamacare), death in the Middle East where his policies have gotten hundreds of thousands if not millions of people killed, hacked to death, drownd, and butchered.

The Nazi party has reincarnated into the democrat party.

The semantics of the current President and "progressivss" define the Constitution's limitations on their power differently than did the Founders and Framers of America's Constitution, which, by its own provisions, limited government and the coercive power which future elected individuals might wish to wield.

From Page xv of "Our Ageless Constitution," here are excerpted words from President Andrew Jackson's Proclamation of December 10, 1832:

"We have received it [the Constitution] as the work of the assembled wisdom of the nation. We have trusted to it as to the sheet anchor of our safety in the stormy times of conflict with a foreign or domestic foe. We have looked to it with sacred awe as the palladium of our liberties, and with all the solemnities of religion have pledged to each other our lives and fortunes here and our hopes of happiness hereafter in its defense and support. Were we mistaken, my countrymen, in attaching this importance to the Constitution . . .? No. We were not mistaken. The letter of this great instrument is free from this radical fault. . . . No, we did not err! . . . The sages . . . have given us a practical and, as they hoped, a permanent* Constitutional compact. . . . The Constitution is still the object of our reverence, the bond of our Union, our defense in danger, the source of our prosperity in peace: it shall descend, as we have received it, uncorrupted by sophistical construction, to our posterity. . . ."

And, it was Thomas Jefferson who used another metaphor with reference to the Constitution when he indicated that "the People" must "bind them (government) by the chains of the Constitution." In another instance, he declared: "It was intended to lace them up straitly within the enumerated powers. . . ."

The only path to making America "great again" begins and ends with understanding of, and adherence to, the ideas and principles underlying the Constitution of the United States of America, as they were explained in the 85 essays of THE FEDERALIST, newspaper essays addressed directly to "the People" in the States prior to their ratification of that Constitution by the people in the states.

We might contrast Jefferson's understanding with today's Democrat Party "progressive" policies which, in effect, would undo all the monumental work accomplished by the Founders on behalf of liberty and leave the law afloat and without anchor, relying, as of old, on mere men and women.
