Given this was one of their early hits..they probably got screwed over by the powers that be in the music industry.

Again this normally should be an ASCAP/BMI/SESAC level issue. That’s the case for 99.999% of popular songs. They take care of collecting royalties and then splitting them up to composers and performers and publishers.

yes, that makes sense...but of course the owner of the composition may not be the composer, right? depends on Aerosmith’s business deal with their record production company? is that right?

I tried to google to see who owns what in the Aerosmith empire ...it’s an interesting question.

Almost black and white really. Either Trump has the rights...or he doesn’t. If he doesn’t, he should stop. if he does, then Aerosmith should shutup.

You mean you can stop someone from playing a song on a speaker in a public gathering? Steve, go get a brain replacement along with those teeth you lost.

I completely get why Trump uses We’re Not Gonna Take It...it’s PERFECT for his message. Dream On? Not upbeat, uplifting musically and the lyrics...don’t really fit.

What am I missing?

In the case of some older songs, rights, in pursuance to publishing agreement, can pass back from a publisher to an artist. However if that is so, the question remains: does the artist have a royalty collection society agreement. If he does and Trump has paid to the appropriate society, then he can only make a courtesy request, he can’t legally kibosh the deal any more than if the publisher had held the rights.

And Trump did not gain the famous Trump status by paying more than he wanted to pay.

If it is Trump's way of dreaming to a victory, then maybe he should use Van Halen’s “Dreams.” It was written by Sammy Hagar and he is known to be a Republican, too. And Van Halen has never been a band to have any conflicts with personalities. The last sentence is a 10 on a 10-scale in sarcasm.

elaborate on the McCartney example?

Didn’t “apple records” own the Beatles catalog? And didn’t Apple computers have to cut a deal with them when they did iTunes? I remember reading that.

I thought the Beatles sort of controlled their catalog, until it was sold to Michael Jackson....and then there’s of course McCartney’s stuff on his own, and I don’t know anything about that. But I bet he was smart enough and big enough to not just sale it outright.

I also remember that pretty early on, U2 bought their music back. Bono always believed in the band and thought their current status - whatever it was - was greater. I bet they paid a lot for it, but...clearly...they have earned that many times over.

It’s all a fascinating question really.

It comes down to capital, and who brings what to the table. And yeah, often, the artists sadly don’t have anything at the table but their music, and they end up losing any profits, control, anything.

Oh...one other data point...I recall from teh movie/musical Jersey Boys that Franki Valli did a side deal with the top writer, and there, they held on to everything and split it 50/50. But early on, they sold everything the Four Seasons came out with. The Four Seasons never made that much; but today Valli is worth more than $50 million ...but only b/c his songwriter thought ahead, and believed in the work they were going to do.

It’s all fascinating, really.....

I can’t believe Trump’s Team never took care of the matter before they played it for the first time. And he certainly would have desisted if he was in violation of someone’s rights.

thanks, that’s good clarification.

With regards to this:

“In the case of some older songs, rights, in pursuance to publishing agreement, can pass back from a publisher to an artist. “

That happens b/c the original deal was for a term of years, correct? At the end of the term, then it just reverts back to the copyright holder? Is that the way to analyze that?

The tunes Trump should be using at his events should be songs such as Good News by George Olsen or Somebody Like You by Jane Green.

LOL.

Good point!

Did you catch how NBC started whining about the miss america pageant after he made some of his early campaign messages?

What did Trump do? He bought them out!

So even in the early days of the campaign, he was DOING A DEAL!

And ...I’m pretty sure he UNDERPAID and I’m pretty sure he’s gonna make a lot of money on his now 100% ownership!

LOOL!!!!!
