Can Kate Steinle's Family Sue San Francisco Over Its Sanctuary City Policy?

Kathryn "Kate" Steinle was shot dead on July 1, allegedly by Juan Francisco Lopez-Sanchez, a Mexican felon who was in the U.S. illegally. Lopez-Sanchez would have been deported but for the fact that San Francisco is a "sanctuary city," which is why officials there chose to release him and ignore an ICE detainer. This effectively put him back on the street. And yet, if Steinle's family tries to sue the city for this travesty, it may be thrown out of court.

IIRC California law precludes a person from suing the police for not enforcing the law.

But that’s not quite the same as suing a city for violating the law.

In Oregon Sanctuary counties came about ostensibly to protect them from suits by ILLEGALS for being held in jail without “cause” or too long

Donald Trump should’ve visited the family to offer condolences which would have assured him additional millions of voters.
Not very smart of him to ignore this opportunity.

Even if California law permitted her family to sue the city government, there's a big legal hurdle they'd face.

It's called the principle of "mitigation of damages." Under this common-law principle, the plaintiffs in a case could have any damages diminished or eliminated if it can be demonstrated that the person in question (the victim, in this case) knew the risks involved in the incident and had an opportunity to mitigate or eliminate them, but chose not to.

In other words, the city's strongest defense in this case would be: "It is commonly known that we have been a 'sanctuary city' for years. If this was a problem for the victim, she should have lived somewhere else."

I remember a case where a guy in a phone booth that was hit by a vehicle successfully sued the phone company because that booth had been hit at least twice before, and the phone company should have moved the booth when it became apparent that it could not reasonable coexist with the traffic flow, regardless of the reason (DUI, distracted driver, weather, illegal alien...)

Therefore, I would suggest to the plaintiff's council to look into the deaths caused by illegals given refuge in SF, and what the city did about it.

SF has a notorious case of 3 in one family killed by an illegal released from it’s jail system when Newsom was mayor. No cranes. Now newsom looking to be governor.

Yes... in this day and age people sue cities all of the time when their offended, or feel disenfranchised.... yeah.. these people have had loss and damage every bit as much as others who sue have had. In reality MORE. I’d award them the money.

Don't stop with the city of San Francisco, sue the mayor, police chief and council members each BY NAME. Last. but not least, sue the illegal alien usurper in the white hut BY NAME for failing to enforce the properly, and legally, enacted immigration laws and statutes.
