An Oklahoma man's last few moments alive after he was accidentally shot last week by a deputy who meant to stun him with a Taser is seen in disturbing video released by police Friday.
"He shot me! He shot me, man. Oh, my god. I'm losing my breath," Eric Harris says as he struggles on the ground with police on top of him.
"F--- your breath," an officer can be heard saying. "Shut the f--- up!"
Reserve Deputy Robert Bates, 73, shouted "Taser! Taser!" before pulling the trigger on his gun, firing one round into Harris.
"I shot him!" the shocked former policeman says, dropping his gun from the recoil. "I'm sorry."
In the video, provided to the New York Daily News, a body-cam captures an officer in a foot pursuit of Harris who is subsequently tackled in the street.

Well if this isn't negligent homicide then what is it?
Even better advice might be to not let 73 year old reserve Deputies who can't tell their tazer from their pistol out on the streets. Had they followed that advice the suspect would be alive today as well.

After the suspect is shot, pinned down on his stomach, with one police put his knee on his head, tells the police he has been shot and can’t breath.
They reply, ““F–k your breath! Shut the f–k up!””
That’s not professional..... That’s 3rd world thuggish police behavior. How long was it before they called the Ambulance?

I know, and I don’t know how they do it- I could never handle soemthign like that- the crap they have to put up with is unbelievable. And like you said it’s constant- nonstop- people just have a real dislike for police.

Egads- then it would become so subjective that it would become like either the days of Noah, where ‘everyone did what was right in their own eyes’ or it would become like Russia where a small minority lord it over the rest of the community- and we’d be far worse off than being policed by a department like the police force who have strict rules and regulations they follow to help ensure people’s rights aren’t violated-
BTW Tulsa Sheriff's deputies are issued .40 caliber handguns, I believe... same for Tulsa PD... at least that's what someone told me...
Little consolation to the family of the deceased, but [being careful what I say here] this unfortunate guy is no doubt connected to the County Sheriff in some way... maybe golf or church buds with him, maybe donated to his campaign - County Sheriff is an elected position here...
Local media reports that Mr. Bates is a long-time "Insurance executive and reserve Sheriff's deputy", IOW an insurance agent by day, rides along sometimes on weekends, in this case watching the perimeter of an undercover purchase of a firearm from a known felon.
Withholding further comment just in case I happen to know someone who might know someone... small world y'know...

I would think that by that point they would know he had actually been shot. That’s an assumption though. Perhaps they didn’t.
I don’t know if several people shot things at the guy and they missed the guy had actually been shot or not.

No. The guy who was shot at the service station. He was shot when he complied with the officer’s demand to see his driver’s license. And the other one may have happened in North Carolina, I don’t remember. He had to use a cane to walk. When pulled over, he reached in the bed of his truck to get his cane and was shot. neither of these were resisting, both were shot. Neither were killed, but it was not from lack of effort by the officers. And while we are on a somewhat friendly basis, I do not advocate or advise anyone to resist the police and that includes running from them. It is a game you are not going to win.

Thanks. I don’t agree that it is murder because there was no intent to commit murder. I could see it termed as an (non deliberate) execution, or manslaughter (gross negligence). Not murder.

I would term it a wrongful (perhaps mistaken) use of an inappropriate weapon resulting in the death of a suspect.
Somewhere along the way, the shooter either wasn’t trained right, or he simply wasn’t equipped to make snap judgement field decisions. He clearly screwed up big-time.
In the video did you notice the other officer telling the driving officer to stop here? The driver simply didn’t listen. That to me could have been an indication that the person driving couldn’t follow simple commands. Makes me wonder if it’s the same guy.
No, it wasn’t murder, but I can understand why some folks get upset when you address that. It was terrible what happened to this guy.
At the same time this guy did not comply with officer’s commands. Once again he was a built individual. This caused officers to consider it a sort of ‘worst case’ scenario. Tasers were indicated.
I cannot help but notice the perp screwed himself over here.
1. He didn’t comply
2. He didn’t get down on the ground
3. Once shot he still wrestled with the officers
4. Valuable time was lost while the officers tried to get this guy under control even after he was shot.
Was this guy taking this as some joke? Did he have a reason for not complying? Did he want to show off for his buddies in the neighborhood? Whatever the case, his tom foolery cost him his life.
If you’ve been shot, submit immediately and let the officers concentrate on after shooting protocol. Don’t keep everyone involved in subduing you so they can’t go radio for an emergency vehicle response.
Some folks will complain that the officers were still trying to handcuff the guy. Officers have to get you under control, and cuffing the suspect is how they do that. You can’t just let him go, or continue to be combative.
I have no problem with the guy being a police officer but at seventy three he should not be on the street walking a beat at his age he should be working the desk
Another resisting arrest issue or not?
I think all of us should “expect” not to get shot in the back 8 times when we are not an immediate threat to harm the officer or another citizen. Last time I looked simple evasion was not a capital crime.

As I said about the Tulsa incident, there's plenty of blame to go around from the old guy who shot the perp "by mistake" to the victim who apparently expected to resist arrest, run away and not have anything go wrong.
