The Phi Kappa Psi fraternity at the University of Virginia said Monday that it is moving forward with a possible lawsuit against Rolling Stone magazine in the wake of the now-retracted "Rape on Campus" article.
"After 130 days of living under a cloud of suspicion as a result of reckless reporting by Rolling Stone magazine, today the Virginia Alpha Chapter of Phi Kappa Psi announced plans to pursue all available legal action against the magazine," the fraternity said in a statement.
A spokesman for the fraternity said there has not yet been a formal decision about when a lawsuit will be filed.
The announcement came one day after the magazine published a damning external review of the editorial processes that resulted in the article's publication. The article had alleged that a freshman student named Jackie had been violently gang-raped during a Phi Kappa Psi frat party in September 2012.

Eh, I don’t know if legally she can be included, but maybe.
However, look at it this way, she was a crazy dame with a crazy story. Esp. people in NYC should know that folks like that are a dime a dozen. This gal might even be truly delusional and believe her own lies (I don’t think that’s the case, but her behavior of making up a fictitious guy and having “him” text her friends which I believe predates any contact with the author of the story certainly paints her as a fairly disturbed person). I’m sure Rolling Stone didn’t make her sign anything swearing to the truth of her story. So it was really on them, the PROFESSIONAL JOURNALISTS as they like to think of themselves to you know, check things out. Which they manifestly didn’t do, and then THEY are the ones who published this story, touted it, put it on the internet. Jackie didn’t do that, they did.
I honestly don’t know if she’s includeable, but I would include her if it’s legally reasonable.
Well, yeah, the conversation is about the dirt rag mag but they have always gotten a lot of mileage out of the name play. The musical group would do well dis-associate themselves clearly from the smutmag——assuming they want to.
