The Justice Department has declined to pursue contempt of Congress charges against Lois Lerner for refusing to testify about her role at the IRS in the targeting of conservative groups.
The department announced the decision in a letter Tuesday to House Speaker John Boehner, whose Republican-controlled chamber made the request to prosecute, after holding Lerner in contempt for refusing to testify at committee hearings.
"Once again, the Obama administration has tried to sweep IRS targeting of taxpayers for their political beliefs under the rug,” Boehner spokesman Michael Steel told FoxNews.com.
Lerner asserted her Fifth Amendment privilege, which allows people to not testify against themselves, during a May 2013 hearing of the House Committee on Oversight and Government Reform and then again at a March 2014 hearing.

First question: Is she a dem or a Repug? If dem, above the rule of law.
The independent counsel law was thrown out by SCOTUS after Billy Jeff's impeachment. They decided it was a violation of the separation of powers - only the executive branch has the ability to prosecute anyone. The only powers that Congress has are the power of the purse and impeachment - for anything else, such as lawbreaking by the executive branch, they must rely on the executive branch to prosecute itself...
If this was a Republican president the RATs would be clamoring for a Special Prosecutor.
In Holder's case, I think Congress could have impeached him and removed him from office, since he had to be confirmed by the Senate. But Congress took impeachment off the table for anyone in this administration a long time ago. And since they refuse to use the power of the purse to rein in this administration, anything else they do is just posturing and making noise.
Under Article II of the Constitution, the primary duty of the executive is to enforce the law.
Well, we’ve seen how that works with these birds.
Under Article I, the Congress determines what the law is.
Here, some would say that the contempt citation expires at the end of the session of Congress, the HOR.
Holder was held in contempt in June of 2012. In practice, the person found in contempt is arrested and taken before Congress.
But at this point, what difference does it make?
As we have seen, at least two branches of government are working together well and as actor Jack Nicholson as President James Dale (`Mars Attacks!’) states after the invasion has begun, “Hey—two out of three ain’t bad!”
In regard to Lerner & the many other Demo outrages (SOS Shrillary: Benghazi, FOI; Koskinan; Clapper; EPA; IRS; `gun walking’; etc.) if a lawyer-as-investigator for a private law firm was hired almost 12 months prior, and ahhhhh, was just getting around to looking into compelling production of discovery, most clients would demand he be s***canned.
But there’s life inside the Beltway, and then there’s the rest of us.
So this is just the Uniparty going through the motions, extending professional courtesy and, like Banana republic dictators, giving the deposed tyrant a pass and a plane ticket—instead of a firing squad—because they expect the same consideration when their roles are reversed.
I never understood why the Justice Department who is under the president is expected to be non partisan.
I think it’s a very weak construct of our system to have the chief federal prosecutor be appointed by the president and be part of the executive.
One has to be a very trusting soul or a fool to believe that such a setup won’t work in favor of whoever is in the white house.
Can another non Democrat controlled entity do something?

and when the justice department balks? its is up to congress to hold Holders feet to the fire.
there is no excuse for the justice departments lawlessness without be called to task.
Boehner can go to a Federal Court and seek a recusal of the Attorney General and make an application for a Independent Counsel to the Inspector General. That is what the next move should be.
Succinctly, message to the GOP, “Cruz or Lose”.
