In a 'very rare' move, judge kicks Orange County D.A. off case of Seal Beach mass shooting killer Scott Dekraai

SANTA ANA – A Superior Court judge removed the Orange County District Attorney’s Office from the case against the deadliest killer in county history, saying Thursday that the defendant’s right to a fair trial had been violated by false testimony and the withholding of evidence.

Judge Thomas M. Goethals, however, refused to block a potential death sentence for confessed mass murderer Scott Dekraai, whose penalty trial is scheduled to start March 30 for killing eight people at a Seal Beach hair salon in October 2011.

Goethals, instead, handed the case to the state Attorney General’s Office. He gave local prosecutors until March 20 to file an appeal.

Wonder how many of this DA’s convicts will get new appeals because of this DA’s malpractice?

"The deputies’ union said the deputies took their cue from prosecutors."

You know things are bad in mudville when the cops and the prosecutors are pointing fingers at each other over who did the dirty.

No. I know people who knew some of the victims. I live about 5 miles from the salon. The church where my son has piano recitals is about a block away.

Why they are having such a problem I don’t know, it’s straight forward, this ahole walked in the salon and cold bloodedly killed eight people the end! Remove the son of a bitch from the land of the living ASAP.

He plead guilty to mass murder. There really shouldn’t be a penalty trial; guilty of mass first degree murder? Here’s your bullet, relatives can pay for the burial of your body, and the cost of the bullet.

As for the whole informants and recordings? I’m sorry, I do not see any violation of privacy or representation - he’s in a jail, he knows there is no expectation of privacy, any statement he volunteers is admissible, and chose to brag about his mass murder to the person in the next cell. Bring on the recordings, and fry the bastard.

The Judge should have LOCKED every one of them up for Contempt, while He personally Filed FELONY PERJURY and Conspiracy Charges against the whole bunch. All of their personal assets should have already been seized under asset forfeiture laws as proceeds of a criminal enterprise.

You know, I never heard “except for the insane” when it was said “”Whoever sheds human blood, by humans shall their blood be shed; for in the image of God has God made mankind.
“(Genesis 9:6)

‘But he’s insane!’

I defy anyone to name the murder of a stranger to be anything other than insane.

This is CA.

A “potential” Death Sentence means 3 Hots and a Cot for the rest of his Life.

Our AG is a Liberal vying for Boxer’s Senate Seat. She has never enforced the Death Penalty.

Nope, I think she will keep out of it, but it makes no difference either way.

No matter the Sentence, the Death Penalty will never be enforced in CA, ever.
