18 year-old Antonio Martin had a criminal record, with charges including three assaults, armed robbery, armed criminal action and multiple uses of weapons since he was 17.
On Tuesday night Antonio Martin drew a gun from his pocket and pointed it at police.
He was shot dead by the officer.
The attorney for the Berkeley police officer said this bizarre scenario may have been a set-up at the store to kill police.
** Antonio Martin and his companion stole from the store before the shooting.
Attorney Brian Millikensays it may have been a set-up. The St. Louis Post-Dispatch reported:
This individual could have complied with the officer. He could have ran away, he could have dropped the gun, all sort of things could have happened. It didnt have to end with him approaching the officer with an arm extended and a 9 mm pistol in his hand, Belmar said.
Milliken said his client recounted the details to him several hours after the shooting.
The other guy was doing the talking, and as the cop starts talking, the suspect starts walking away again, Millikan said. At that point, the cop says, Hey, come back here, and he turns around, pulls a gun from his left pant pocket.
Hes trying to process all of this, and the suspect raises it, points it at him. The cop pulls his weapon and starts backpedaling and fired three or four shots. It happened that quickly. He doesnt understand why the suspects gun didnt fire. Im not sure if he tried to pull the trigger and it jammed.
Belmar said as the officer backpedaled,he stumbled and dropped the flashlight. Berkeley Mayor Theodore Hoskins, in a news conference later Wednesday morning, said it may have been a blessing in disguise.
I think the officer, because he stumbled, may have saved his (own) life, he said.
Millikan said its possible that his client was being set up for an ambush.
Store employees called 911 after the suspects stole from the store, Millikan said.
Their behavior is certainly bizarre, and it wouldnt surprise me at all, in the environment we are in, thats for sure, Millikan said.
Police were attacked after the shooting.
The videographer says the protesters were throwing bricks.

When they finish the toxicology report....I’d like for it to be made public. And I’m ready right now to lay down a bet....he’s got high marijuana THC levels...and probably wasn’t comprehending what he was doing. This act of smoking four or five joints a day and thinking ‘it’s Ok’.....no, you can’t do it without some consequences in between.
The usual suspects are claiming the cops planted the gun, anything to “justify” rioting.
Been watching it develop for 50 years.
In other words the outcome was - Police Assisted Suicide - PAS
ave this become the police motto instead of - Protect and Serve. End of Life Counseling - Present Gun - Go Six Feet Under.
it just seemed so odd that after the shooting of Antonio Martin , his mother was there to identify the body, than came the explosives and bricks. How long did Antonio’s carcass lay in the convenience store parking lot, before the investigation was completed?

They need to go on the NY PD "war patrolling" schedule,
(1). Starting IMMEDIATELY: At least two units are to respond to EVERY call, no matter the condition or severity, no matter what type of job is pending, or what the opinion of the patrol supervisor happens to be.
(2). IN ADDITION: Absolutely NO enforcement action in the form of arrests and or summonses is to be taken unless absolutely necessary and an individual MUST be placed under arrest.
(from earlier posts from NY)
Martyrdom. He wanted the Rev Sharpton to talk about him for once.....
However, the last few months (weeks? days?) have brought this trend into very sharp focus. It does not look good at all.
Kenny, I am going to send you some slate blackboard upon which, you may drag your fingernails.
Exactly the time since Democrat Daniel Moynihan predicted in 1965 EXACTLY what has been happening since.
Looks like they are waiting for the police to show up. Then move in as he comes to a stop.
I was going to mention you in my Christmas prayers. Now I may be praying for the lion!
Merry Christmas!
I wish you language trolls would leave grammar out of this, she has been dead nigh 20 years.
I have three family members who are laws enforcement officers (well, one of them is now retired). It pisses me off to no end to know that there are a$$holes out there who will target them merely because they wear a badge. Their brothers and sisters in blue, and a hell of a lot of us citizens, have their six.
No way, José! She's just kinda sleepy and real sick like. Didn't say nothing about no DNR before she has went into a coma. Maybe CPR? Besides, old people need grammar to at least talk to each other.
Merry Christmas.
It looks like the officer dropped his weapon while he was rapidly backing up after firing the shots, as you can see the weapon skidding across the parking lot toward the gas pumps, and the officer just keeps on backing up until he gets near the street, leaving his weapon on the ground between the suspects and himself. It looks like a justified shoot, but the officer needs to go back to school on how to handle himself in such situations because YOU DON’T LEAVE YOUR WEAPON!
That would be racist and Sharpton would order more cop killings.
Merry Christmas
I just sent to several folks who are bellyaching on face book this morning about more "police brutality" on blacks
It certainly "looks" like a set-up...
I know criminals aren't the smartest lot on the planet, but one would think they knew the camera was out there to record what was happening and be able to identity them...
Of course they might have thought they were out of the angle of the camera...
