Democrat Chad Taylor must stay on the ballot for U.S. Senate in Kansas, Secretary of State Kris Kobach said Thursday afternoon.
Kobach said Taylor submitted a letter Wednesday to withdraw from the race but did not declare he was incapable of serving, which is also required.
The Kansas Republican Party had questioned whether Taylor, the Shawnee County district attorney, could withdraw.
Kansas law means we now have no choice but to put Taylors name on the ballot, Kobach told reporters at an afternoon news conference. The law is the law.

Nothing like watching the Dems shoot themselves in circular firing squads.
We’ll see if the Dems get a judge to overrule Kobach. They can always find one to disregard rules.
Don't be so sure.
When Robert Toricelli (NJ senator) got caught taking bribes from a North Korean connected "businessman," it was too late for him to withdraw from his tight race against Doug Forrester.
But that was no problem for the Democrats. They just went to the New Jersey Supreme Court, which ruled (unanimously) that they could "legally replace" Toricelli's name with that of Frank Lautenberg on the 2002 ballot.
Lautenberg went on to win against Republican Forrester.
I love it when the rats outsmart themselves.
It’d be funny if this was the deciding race for the Republican takeover of the upper chamber.
Early Thursday, Kansas Democratic party chairwoman Joan Wagnon said her partys legal plans were still under review. But she sharply criticized Kobach, a Republican, for injecting himself into the ballot dispute.
He is partisan, and mean, and he has made an unmitigated mess of our electoral system, she said. He ought to keep his hand out of this one.

Taylor needs to be very careful to avoid any unfortunate accident.
This is not over. Taylor will likely come back and say that he cannot perform the duties of the office due to some terrible trauma in his personal life, a bad case of hemorrhoids, or some such excuse. At that point, Kobach will have to rule on the request. He will probably say no, and lawyers will be standing by outside the offices of their favorite Lib judge with a petition for an immediate injunction. Fur will fly. My guess is that he stays on the ballot.
The best part is getting the Democrats with their big lawsuit to give more publicity to the fact that Orman is a liberal and backed by the Kansas Democrat party.
You're not cynical enough. The Political Class does not want to upset the applecart, especially in the bought and paid for and mostly disloyal US Senate. Having both the Independent and the tarnished Dem in the race assures that Pat Roberts will keep his seat. If the dem were taken off the ballot, the Independent had a chance of winning.
It will be fun to watch. Tickets are going fast, better get on Stub Hub now.
Ballots need to go to the printer Friday night.
Isn't that racist?
Kansas is not New Jersey
Well Joanie, he may be a meanie, but he was elected Secretary of State and it is his job to certify the names on the ballot. Wagnon is going to need some new panties.
Yes, I bet they’re judge shopping right now. Maybe they can get the Bob MCdonnell judge.

More Criminalcrat hyperbole.
She was crowing and giggling and beside herself with glee about the Dem candidate's withdrawal, claiming it would eliminate the Republican's chance to take the Senate.
Wonder if she's still giggling.
This is quite a knee slapper! Hehehehehe!
