exas Gov. Rick Perry slammed President Barack Obama on Fox News Sunday, once again demanding the National Guard, and called on Obama to stop the blame game and get up and lead.
Host Brit Hume asked Perry to explain why he wants the National Guard sent to Texas, inquiring skeptically, What exactly would National Guardsman and women do on the border?
Perry explained that the National Guard acts as a front-line deterrent for illegal immigrants, and is critically important now, because most border patrol agents are stuck taking care of the illegal immigrant children. The president was not even aware that his border patrol was back 40 or 45 miles from the border at these checkpoints, he said. They need to be right on the ripper, they need to be there as a show of force.
This flood of children is pulling away the border patrol from their normal duties of keeping bad people, keeping the drug cartels, theyre being distracted.
Hume pushed back, questioning how effective the National Guard could be when they arent allowed to actually detain anyone. Theyre not, under the law, allowed to apprehend any of these children that are crossing, are they? Hume asked.
Its the visual of it thats the most important, Perry countered. Their conversations are being monitored with calls back to Central America, and the message is hey come on up here, everything is great, theyre taking care of us, and that needs to stop.
Hume then asked if Perry thought the presence of the National Guard would really deter children who have already made the harrowing journey.
Are they really going to be deterred by the presence of troops along the border who wont shoot them, and cant arrest them?
What were talking about is sending the message back now to staunch the bleeding, Perry replied. Those that are already here, to address them, to humanitarily [sic] take care of them, to make sure they are safe to reunite them with their families that is the most humanitarian thing we can do.
Perry again stressed the necessity of the National Guard to help get border patrol agents back to their actual jobs. Right now, reports of up to 70 percent of them [border patrol] are taking care of these young people who have come in, rather than do their job of securing the border.
Hume brought up President Obam, and his hope that Perry would put the heat on the Texas congressional delegation to pass this nearly $4 billion dollar measure that he is proposing.
And Perry had some choice words for the president.
Very little of it [the bill] is for border security. And I think until he gets realistic about the problem and how you deal with the problem, and it is a border security issue, and weve got a track record now of five plus years of him disregarding what is going on on the border, so heres his opportunity to truly lead, Perry declared.
Dont blame this on anyone. Be a leader, lay out a plan.
Hume then asked Perry to clarify if he was saying he would disregard the president and not pressure the Texas delegation to pass the bill.
So in other words, governor, you dont particularly support the bill, and youre not going to be encouraging your delegation to pass it. Is that a fair assessment?
I think you have distilled the correct answer, Perry replied.

I just don’t understand why he doesn’t take his state’s responsibility more serious than what he does. The gangs are recruiting in those holing centers while terrorists are slipping in as well. I realize he is thinking all politics here though Perry could just deploy the Texas National Guard. It’s way overdue (Imo).
Perry should not plead with Obama’s administration any further in helping to protect that border. They are not about to do it. Have a showdown, once and for all. People will support this. Most people that I talk to are very angry about the illegals coming in. It’s insane in how the government has been handling this for years (now this)... Are we a sovereign nation or allowing for open borders. Didn’t 9-11 change our way of thinking. It’s unreal what is going on!

The Federal government was DELEGATED certain powers.
IF IT FAILS to do those things, the States can do them themselves!
You have a state being overrun illegally with illegals. The feds are not going to do anything at this point other than planning train stops to encourage this mass invasion to occur. By bringing the Texas Guard in puts this rightly so in a discussion of this border and states’ rights. Pretty soon, the country will not be sovereign any longer. Talk is not getting this country protected.
Mexico has **no incentive** to stop the movement of illegals, as they have done in the past. Perhaps payback for Fast and Furious?

NO **rail traffic** or goods to Mexico. Or *from* Mexico.

Fine the US partners (Yes, US companies own/run the railroads in Mexico, look it up) if steps aren't taken to stop train hoppers.
If these don't work -
Disable the rail link between Central America and Mexico proper. (ie the Beast) Destroy a single bridge by drone strike if needs be.
That stops the incoming.
For those here - land C-17s at McAllen and start loading 'em up. Honduras has over 30 airports. Land in rotation and spread the wealth **back home** for them.

Specifically in terms of military authority: If Perry calls up the Texas National Guard and sends them to the border again (hes done that once already as governor) the Feds will then exercise their option to nationalize the TNG and send them home (or they can send them anywhere else, actually.) Federal control of the National Guard has long since been established.
In short - Perry can call out the National Guard, but the Feds can countermand his order if they want to.
There is also the Texas State Guard that answers only to the state of Texas, but its less a combat outfit and more an engineering, medical and logistics outfit in terms of their expertise and deployment. The State Guard is also not very big and not well funded - but theyre already deployed at the border anyway. Theyre currently running Operation Border Star VII in conjunction with other agencies.

Yeah, a lot of people dont know the command structure. Also, I used the wrong term - its not nationalized but Federalized. Anyway, its a little more complicated than that but thats essentially how it works.
As mentioned yesterday, he could be trying to visibly exhaust all his alternatives before going ahead and calling out the National Guard. Basically, he could be creating an atmosphere where it would look very, very, very bad for the Feds to try to Federalize the deployed National Guard. At this point, the Obama Administration is starting to shy away from that sort of thing when the media spotlight is on an event.
I dont know that this is what hes doing, but his actions are consistent with it.

BO can call up the TNG under certain conditions - but if he does the callup, the Feds have to pay for it and the Feds are responsible for their actions just like any Regular Army unit. There are also limitations on how, when and why the Feds can call up the Guard, even with the approval of the states governor.
However, if Perry calls up the Guard for State Active Duty, Texas gets stuck with the bills. Oh, and the Feds can demand to be reimbursed for used supplies, equipment, ammo, etc. at almost whatever rate they feel like naming. The Feds can also Federalize the called up unit and then do whatever with it - up to and including sending them to Iraq or Afghanistan.

How can one's actions against "authorities" who are acting against the charter from whence they derive their authority be illegitimate?
This is to say: is acting against one acting under the color of authority, even when it is clear they are outside their sphere of authority, prohibited?

Hume has really turned into a lefty the past few years. He should move back to ABC.
I don’t guess the NG would do any good if our media constantly reports that they can’t do anything. Personally, I think they should be allowed to shoot to kill. Especially when a drug runner runs his SUV into the river and starts swimming. Shoot him before he gets halfway across.
Part of the reason we have States is in local and regional power and speed in process.
Our founders 'gave' certain 'powers' to a State. In the past those powers were abused at times, but Governors have to power to engage in war with foreign invaders and threats. Part of the reason States have that ability was the conflicts with Indians, and such.
Only Congress and a State can enter into a war.

'No state shall, without the consent of Congress, lay any duty of tonnage, keep troops, or ships of war in time of peace, enter into any agreement or compact with another state, or with a foreign power, or engage in war, unless actually invaded, or in such imminent danger as will not admit of delay.'
It appears Perry’s choice will be to raise taxes to pay for the NG or raise taxes to pay for immigrant children’s upkeep.
The NG commanders could say fuck you
and ignore those illegal orders — if they are called up to stop an invasion then Art 4, Sec 4 of the US Constitution compels the federal government to provide assistance, removing manpower is the opposite of this and is Treason according to the US Constitution:

Doesn’t the National Guard report to the governor unless called into federal service? So why doesn’t Perry send the Texas national guard to the border on his own authority?
It’s long been time for Rick Perry to display some leadership, and it’s not a surprise to many that he has not.
