Court won't reinstate New York City's big-soda ban

ALBANY, N.Y. (AP) — Guzzlers prevailed Thursday as New York's highest court refused to reinstate New York City's ban on the sale of big sodas, ruling that the city's health department overstepped its bounds when approved the 16-ounce cap on sugary beverages.

The court largely ignored the merits of the ban in the 20-page ruling, but determined the city's Board of Health engaged in policy-making, and not simply health regulations, when it imposed the restrictions on restaurants, delis, movie theaters, stadiums and street cart vendors.

Ha! Suck it, Bloomberg.

I would like to add that I don’t even drink soda any more....just water, some occasional iced tea and one cup of coffee in the morning.

However, I don’t think it’s my business (or especially the government’s) to tell people NOT to drink it.

That's a telling statement by the reporter. Its typical Liberalism. Well, its healthy to not drink 32 oz. sodas so why did the court strike this down!?!?!

I’m the same as a lot of you here. I never drink soda, and I only drink water these days, but people have a right to make their own decisions without a nanny telling them what to eat, what to drink, where to set their thermostat, etc. Plus this shows Bloomturd that even with all of the money in the world he does not get to be a little dictator.

Excellent point! It’s amazing how the mind of a liberal works: Abortion? Safe and a good idea to them. Homosexuality? Safe and a “fabulous” idea to them. Large Soda? NO GOOD IT MUST BE BANNED!
