This isn't related to the core enumerated powers questions in Bond but struck me as sufficiently interesting that it was worth posting about separately. In his post about Bond, Mark Tushnet writes:
This isn't Justice Thomas's problem but James Madison's [but] Justice Thomas quotes Madison to the effect that treaty cannot "dismember the empire." Really? Suppose Vladimir Putin lets the United States know that he's going to bomb the bejeezus out of the "red" states of the United States unless we negotiate a treaty returning Alaska to Russia. Work out the scenario as you wish, but I doubt that it's a good constitutional design to require the U.S. government to take the negotiating position, "We're fine with giving up Alaska but unfortunately we can't do it, so bomb away."

Our 49th State for a Horse....
An independent Alaska, even as a Russian vassal state, would at this point be superior to living under the 0bomunist regime.
Obama would gladly get rid of Palin and all that evil oil...
“NOPE... all that money we gave to russia was Colonial Blood Money used to control Russia according to obamas mentors and by extension Ubama...”
I forgot the /sarc tag. ;-)
Obama would read about it in the paper and be really angry.
...then go golfing.
...and ironically, a living document is a dead document.
0 would spray paint a red line on the snow!
Alaska is tooo cold for Obama ,so bye bye
What is this guy talking about?
Who is Bond? Who is Tushnet?
“The Constitution provides for the common defense, not the partial abandonment.”
Aw, come on. The Constitution’s a LIVING document, subject to the whims of whomever makes, interprets, or enforces the law. We know because the Wise Latina has told us so.
> “Suppose Vladimir Putin lets the United States know that he’s going to bomb the bejeezus out of the “red” states of the United States...”
As long as it was the “Red States”, Obama would say, “OK, go ahead.”
Good point.
~Amazing that Russia, as gigantic as it still is, at one time had huge Alaska.~
LOL. Also Northern California, not to mention Finland, Poland, Ukraine, South Caucasus, Mongolia, North Korea and North Iran.
Between 1540s and 1910s Russia has expanded at average 50 square miles daily.
bammy would give it back so fast....
