Two Oklahoma death row inmates (whose crimes both involved the brutal rape and murder of children) sued the government in order to find out the source of the drugs used in the lethal injection that they would receive. After the Oklahoma Court of Criminal Appeals gave the go-ahead for the executions, the states Supreme Court granted an indefinite appeal to the inmates. However, an Oklahoma House member drafted a resolution to impeach the justices who granted the stay, precipitating a 180 degree turnaround by the OK Supreme Court.
From The Guardian: The Oklahoma supreme court has dissolved its stay of the executions of two men who challenged the states secrecy about its source of lethal injection drugs. The court reversed the decision of a district court judge who said the law that keeps the source secret is unconstitutional.
OK folks, let’s have some follow through and actually impeach them and remove them from office.
Utterly absurd. Impeach because you don’t like a ruling? Rulings of this type aren’t just about “bad people” they involve government secrecy etc. And a ruling you don’t like is NOT a reason to impeach a judge. Bet the Libs would LOVE impeaching 5 of the SCOTUS Justices. To be consistent I assume that’s OK with some of you?
Those of you calling for anarchy, have a good time with that. If you think you’ll win that one ... well, I needed a good laugh.
Along with imprisonment.
Prepare to be deservedly flamed.
“The courts reversal on Wednesday came hours after a resolution by an Oklahoma House member to try to impeach some of its justices.
In removing the stay, the court said the inmates had failed to demonstrate actual injury and that the right of access to the courts does not include the right to discover a cause of action to litigate.”
“Not satisfied with the Supreme Courts reversal, articles of impeachment have been filed against the five justices who voted for the stay. The articles charge that they improperly exercised jurisdiction over a case in which the Court of Criminal Appeals had sole jurisdiction.”
“Sole Jurisdiction” are the key words!
The OKSC had no jurisidction...
Shoulda kept reading before posting like I normally do, but a post upthread was just too obnoxious to ignore.
Thanks for posting additional information.
More like impeach because a ruling is so wrong that the people that ruled that way need to be off the bench.
Your close association with the so called 'justice' system biases you.
Excellent move by Oklahoma and one that should be followed by every state and the Republicans in the US House and Senate.
Each time a judge rules against American Values, the Bible or an originalist interpretation of the Constitution, we move to impeach.
I’m sure their constitution says their justices serve “on good behavior.” That’s their call if they find their behavior is beyond the pale.
I like Alabama’s system, where justices have to stand for election. The US Supremes have repeatedly made themselves political animals, and they should be treated accordingly. This depravedly “independent” judiciary at the national level is the one grave mistake our Founders made.
Years ago Californians voted out Chief Justice Rose Bird and two other judges sitting on the California Supreme court. Other than voting in Reagan twice, the best thing the state’s voters ever did.
If the decision that was appealed was from a state district court, then yes they do.
‘Those of you calling for anarchy, have a good time with that. If you think youll win that one ... well, I needed a good laugh.’
Impeachment=Anarchy. I hadn’t heard that one. I guess the Big 0 is safe then.
I have no problem with the Okies impeaching judges that are insane. Matter of fact I am for impeaching everyone in the Big 0’s administration that can be impeached for unAmerican activities or whatever, just being ugly is enough for me.
I get the feeling that maybe freedom=anarchy with you. Tell me if I am wrong.
Does the Court of Criminal Appeals meet that criteria?
If the court wants their decisions to be respected, then they need to be respectable. We are slouching toward anarchy under the current regime and they are too dense to see that there is a breaking point.
The argument could be made that this demand that the state disclose the source of the drugs is a civil matter and does not fall under the jurisdiction of the Court of Criminal Appeal. And there's an out: "...the Court of Criminal Appeals shall have exclusive appellate jurisdiction in criminal cases until otherwise provided by statute and in the event there is any conflict as to jurisdiction, the Supreme Court shall determine which court has jurisdiction and such determination shall be final."
They botched the execution but the guy finally died 30 minutes after they closed the curtain.
But the other death row inmate now has a stay because they have to do a 6 month investigation on why they botched the execution.
Seems pretty clear to me.....
Sole jurisdiction...means what it says.
