A plan to ban "frequent and large gatherings at neighborhood homes" is a lawsuit waiting to happen, a Fairfax County supervisor predicts.
Officials will get an idea Wednesday when public-comment hearings begin in Virginia's most populous county.
"I believe the county is risking a lawsuit and/or a constitution challenge by interfering with peoples' right to assemble," Supervisor Pat Herrity said in a statement.
The proposed zoning ordinance limits "group assembly" at residences to 49 people a day. Such gatherings "shall not occur more frequently than three times in any 40-day period."

Fairfax has turned looking the other way when it comes to houses being used as hostels for migrant labor into an art.
Happened to the house next door to me, once. County ignored it, HOA at least told me they wouldn’t touch it due to the threat of discrimination suits.
Ended up selling and moving, especially since the guys staying in the house would stare at my wife and young daughter.

this proposed law could have been passed in RED CHINA in years past...
Tyranny is always probing deeper into our basic rights. We must be ever vigilant! Whoever is sponsoring this should be forced out of office as an example to all the other fascists.
Where my daughter used to live (in a cul de sac in a middle class neighborhood) there was a house across the way jammed full of illegals. Heck, they even served as a waypoint and sometimes you’d see large campers parked outside for a few days (dumping the crap pipes into the storm sewer).
Everyone in that immediate area tried to get the HOA, the police, etc. to do something, but nothing. Eventually, the illegals who ran the place lost it in foreclosure.
She moved and built a new house, and rented that house for about 18 months. The sale on it closes next week.
In Houston, 100+ illegals were found in a suburban house living in filth. Obama is encouraging such activity by banning deportations.
In Texas, I can legally open carry my handguns on any piece of property that I own or control (i.e. lease, rent, etc.).

You don't need that 30 round magazine.
You don't need that "assault weapon."
You don't need privacy/security in your car.
You're near the border, you can be stopped and questioned.
In ways big and small, all across the Country our rights are being eroded away. Oppose the fascists and you'll be shouted down with "It's for the children!" or "Its for your safety!" or "It's for xyz, how can you oppose xyz!?" or "But you don't need xxx!" or "But if it saves just one life..."
We're on our way all right, and I think we're in a handbasket...
"the right of the people peaceably to assemble"
We are in a freefall, My FRiend. And well on the way down.
That’s what I’m thinking. If something like that happened in my neighborhood... Well, I know several people up and down my street (myself included) that would make life very, very difficult for an illegal’s home. You don’t need police nor HOAs. They’d get the hint right quick.
The War on Christ.
Stop the home churches, reduce the organized church to a department of the state.
Police State? What Police State?
Love to see this enforced at a post-funeral family gathering.
Sounds like a zoning issue to me. We own rentals in a neighboring county where we are limited to three adults in a house and three cars at the property. Everyone ignores it though.
This law would require each local to have “monitors” watching and reporting to the police. I can almost see it now, “Dear sir or madam, you are nearing your 40 day limit for gatherings.....”
Then they will just lower the group size to 25 and extend the days to 50......
Soon it will be illegal to go to your own house.
49 would be a bit large for a home church. Where would everyone park?
I’m not sure what they are fighting but if it is illegals, a federal judge will overrule it.
