DCF deems alleged assault of boy, 11, ‘consensual’ sex

An 11-year-old autistic Middleboro boy’s claim that he was sexually assaulted by another youth inside his foster home was dismissed as “consensual” sex by child welfare officials charged with protecting him, in a stunning case the boy’s family and school officials charge was plagued by missteps by the embattled Department of Children and Families.

According to DCF investigative reports, police reports and letters, the boy — then 11 but with the cognitive ability of a 5- or 6-year-old, his father told police — was allegedly sexually assaulted by another youth in the foster home while the parents slept during the early morning hours of May 2, 2009.

Officials at Massachusetts MENTOR, a state contractor that supervised the foster care, said they immediately removed the 11-year-old from the home, but they didn’t take him to the hospital because both boys initially said the incident entailed only touching and rubbing — actions officials described as “consensual and experimental.”

But two days later, the boy told a teacher at Amego he was “harassed” into sexual contact, prompting school officials to rush him to a hospital to be examined.

Both the autistic boy and the other youth described the contact as sexual in nature — and that it had happened three to four times — but DCF investigators, in wrapping their probe, indicated it was consensual, writing in a report that “the boys took proactive steps to avoid parental detection.”

DCF investigators never interviewed either of the boys, citing a potential criminal case, and said doctors found no evidence of “tears or bruising” on the autistic boy, though, as one social worker pointed out in the probe, the examination didn’t come until days afterward, according to an investigation report.

Here in now-third-world California, a new perennial of the MSM is outrage that American Mexicans being arrested for statutory rape because they’ve gotten married here at age 15.

When you can point to CA for an example of the legal system getting it right, you’re in bad shape.

The age of 15 used to be a fairly normal time in all cultures for getting married or engaged; a woman was considered a potential old maid in England if she made it to 18 without being married or engaged, and if she hit 21 she was definitely an old maid. In the past, most states in fact permitted marriage for girls after the age of 14 with the consent of their parents. That is, they permitted marriage, not sexual abuse. Obviously, customs have changed, but early marriage is not in the realm of sexual abuse.

However, the problem with the mentally ill or the developmentally disabled is that they are very easily victimized because the law simply says, oh, it was voluntary. I worked in a group home and there were some local people who thought it was very amusing to stop one of the residents on his way back from the sheltered workshop and give him a quarter to masturbate in front of them. But it was “voluntary,” right? And they were technically adults, so the law didn’t care about this humiliation.

In this case, I don’t know why they’re not being a little more energetic in their response. Victimization at group homes is a constant problem.

Honestly, it would be extremely hard to determine what happened based on the word of an autistic 11 year old, especially after he had been coached or prompted. I agree that the incident was unhealthy, and the boy should have been removed from that environment. The other boy should get some help, but not have his life ruined. The boy’s father (if that means biological father) really isn’t in a position to complain, but he may be “entitled to cash compensation” in the eyes of his attorney.

Everybody needs to calm down, get off their high horse, apply a little common sense and a touch of charity and grace,, and do what is right for the boys involved. The autistic boy’s father needs to STFU until he is ready to raise his son himself instead of turning him over to the state.

Nothing, consensual sex or most anything else, is truly voluntary for persons afflicted with autism. They simply do not have a full enough construct in their minds of what the outside world is like.

Their lives are guided by very specific parameters, and sex of most any kind is just not part of their psychological make-up. Autistic children, or even adults, exhibit what is for most other people, an uncommon level of obsessive-compulsive behavior, as they tend to be totally logical in following a train of thought, and emotion, in their minds, is not a logical thing. Think Mr. Spock of Star Trek, or maybe Data.

Autistic individuals are extraordinarily good in something like the study of mathematics or theoretical physics, and almost entirely incapable of carrying on a jocular, two-way interaction with other human beings, their social skills being almost non-existent.

Probably explains a lot about myself, come to think of it.

Actually, most working-class women in England, which means most women, married in their mid to late twenties, after they and their prospective husbands had saved up enough money to establish themselves.

In America, where there was open land, an early age of marriage was far more common. When land ran out, as in 19th c. Massachusetts, the age of marriage went up again.

And why I’m tangenting off on this I don’t know. If the boys were developmentally five, well, five year olds play doctor.

There are some group homes for adults I’ve been to as an EMT, staffed entirely by Caribbean immigrants because it’s low wage work. Our society isn’t willing to pay much to care for the mentally disabled but I do believe that institutions of a modest size would be better than isolated group homes.

Where do you live? There are some pretty sick “locals” in your neck of the woods.

I just can’t imagine. Maybe my mind just doesn’t work that way. What? You just say “Hey Bubba, here’s a quarter. How’s about pulling your pee-pee out and choking the chicken for just a bit?”

Sounds like there are a whole bunch of “locals” that need to be in a group home. Or shot.

I lived in England for a large part of the 1980s and the teenaged “old maid” sentiment was still strong then.

It was a small city in Western Pennsylvania. The resident was about 25 years of age, but had a mental age of 4. The people who paid him to do this were young men in their 20s.

It’s amazing how cruel people can be.

Marriage at 15 made sense when the life expectancy was in the 30s and 40s. Can’t have big families with lots of children if you’re getting married at 21 and dead by 35.

A minor (especially one who is mentally challenged) cannot legally consent to such activity. Additionally feminists have made the rule that even if a woman initially provides consent, she can later revoke said consent and claim pressure, coercion, and intoxication as reasons the other party is to blame.
