Attorney Gen. Eric Holder called upon the nations school districts Wednesday to re-think zero tolerance disciplinary policies that he said disproportionately punish minorities and push too many students into to the justice system.
Alarming numbers of young people are suspended, expelled, or even arrested for relatively minor transgressions like school uniform violations, schoolyard fights, or showing disrespect by laughing in class, Holder said during a speech in Baltimore.
Holders remarks accompany the release Wednesday of new federal guidance from the departments of Justice and Education pressing schools to adopt disciplinary policies that are fair, non-discriminatory, and effective.
The guidance lays out the parameters of punishment as governed by federal civil rights protections, alternatives to exclusionary discipline and a comprehensive list of regulations on the books in every state.
Included in the guidance is a 32-page Dear Colleague letter putting schools on notice that the agencies are prepared to use authority to investigate the claims of racial disparity in the punishment of students.
As part of this commitment, we will enforce Federal laws to eliminate unlawful racial discrimination in school discipline, the letter warns.
The action won praised from the American Civil Liberties Union (ACLU), which offered forward research showing that black students make 36 percent of those expelled, though they represent only 15 percent of students.
"With the rise of law enforcement in our schools, the proliferation of zero-tolerance policies, and misuse of suspensions and expulsions, our nations school discipline policies are pushing children out of school," said Deborah J. Vagins, the ACLUs senior legislative counsel.
The Education Department us also issuing a set of guiding principals meant to help schools comply with federal laws, a directory of disciplinary resources available to schools and an online compendium of state laws and regulations.
Positive discipline policies can actually foster safer school environments, without a heavy reliance on suspensions and expulsions, Education Secretary Arne Duncan said in a statement.
Schools also must understand their civil rights obligations and avoid unfair disciplinary practices, he said. We need to keep students in class where they can learn.
Agreed - no-tolerance policies regarding even images or representations of firearms are destructive, insidious, and serve to mold a new generation of serfs who fear guns and believe they are only properly possessed by government.
Leave it to Holder to take a good cause — pushing back on “zero tolerance” school policies — and pollute it with a needless racial angle.
Poor behavior, socially (correlated to race though) based, needs correction.
When schools must report suspensions by race, they naturally stop suspending the black kids as much, the black kids know that, and misbehave even MORE.
I know. I hear it every night at the dinner table.
Way to go, Eric! Holding your people to lower and lower standards will confine them to the liberal ghetto forever.

The best thing to do is put minorities in their own schools so that they can be disciplined as their “community” believes is necessary.
Question—how are we supposed to deal with feral youth, who are raised in ghetto culture? A culture in which trying to do well in school is derided asacting white? A culture in which all slights, real and imagined, are settled with violence?
Against this backdrop, teachers are supposed to try to socialize these feral youth. But any discipline administered is considered racist.
That’s the crazy world we live in now.

There would be an easy way to prove that minority students are being unfairly disciplined. Jut put cctv in all classrooms with minority students. The result, from many sources I’ve read accounts about from on the internet, would not be to Eric (my people) Holder’s and other racialists liking. From what I’ve read many or most classrooms with majority black students are chaotic, semi-violent nightmares. So let’s do the camera thing, and see who’s lying.
Statistical drivel. They need to examine the rate of expulsion with the rate of expulsion-punishable offenses. They can break THAT down statistically and have a meaningful answer.

What these kids were doing needs to drive the expulsion rate.
If a white person called for easing up on standards set for blacks as Holder is doing...

Holder once said we need to hold a national conversation on race relations here in the US. OK Eric; how’s this for a topic:
How come we let blacks have an unfair advantage in education, in employment, in housing, and in every other aspect of life and it only increases their welfare roles, prison populations and illegitimacy rates?
