You get your card back, go to another store and use it.
The test would be who's name did she sign on the credit slip. If she signed the name on the card, she knew. If she signed her own name then maybe she didn't notice.
Certainly reasonable doubt.
This is why I never pay with a credit card in a restaurant anymore, unless it’s at the cash register.
