Zimmerman Redux: The Breaking Louisiana Self-Defense Case of Merritt Landry

Merritt Landry, a 33-year-old “white caucasian” shot the victim, a 14-year-old black boy, in the head. A single spent cartridge case was recovered at the scene, indicating that a semi-automatic weapon was used and suggesting that a single shot was fired.

The hour of the shooting was approximately 2:00AM, on Friday, July 26, 2013. As of this writing the victim is reported to remain alive, in critical condition at a local hospital.

FReepers, here is a personal experience that may save someone some grief.

Yesterday the doorbell rung. I was working in my office downstairs and my wife was downstairs as well.

We have two locks on our front door, a 'regular' lock that is reinforced and a double keyed deadbolt. The outer door, a storm door, is also kept locked.

My wife, being the more socialable of the two, answered the door. Hearing a conversation, I got up from my office and went to see who was there.

To my utter amazement, my wife had opened the inner door, and also had unlocked the storm door to listen to the unwelcome visitor.

The visitor was a tall, black male wearing a faded t-shirt with a Washington Gas logo, had an ID card on a chain around his neck, and was holding a clipboard.

I immediately interrupted the conversation and asked the kid what he wanted. he mumbled something about offering a discount on our existing utility bill, mismatching the gas company he was supposedly representing with our electric utility provider. I invited him to leave and called the police.

I have told my wife many, many times NOT to unlock and open the outer door to a stranger, especially to someone fitting this person's profile (you're damn right--I profile).

I asked my wife why she opened the door after hearing my lecture on security for scores of times over 22 years. She said the person was speaking softly and she couldn't hear them.

In my view, we were lucky--this time.

We are aware of that, but when the race baiters and their allies in the media find an incident that helps them in furthering their agenda, facts don't matter, the truth does not matter, and the law does not matter. What remains to be seen is will this case fit their paradigm.

Except Mr. Landry, if reports are accurate, gave no warning,offered no challenge, or made his presence known before shooting. That would seem to invalidate his rights under the La. Law.

I’m up in North Louisiana, so all I get is what is in the newspapers. Which usually ain’t accurate. I’ll see what some of the local blogs are reporting.

And that was an easy situation to discern. Often home invaders use a girl to get the front door to open. Home invaders are often like vampires: they don’t break in, they are let in. Also, watch out for your open garage door. Home invaders often walk in through open garages. Once in the garage, there is almost zero chance of their actions being seen or heard by neighbors.

NEVER NEVER NEVER OPEN YOUR DOOR TO UNEXPECTED VISITORS!

The teen in the light tank top climbed over Landry’s fence and into the yard. Landry’s large dog began to bark, alerting Landry to the intruder.

This is from the article. The punk jumped the fence and proceeded toward the house...at 2 o'clock in the morning! This punk does not need to be educated by his parents on trespass laws, because they understand what they are doing.

The section of Louisiana law you quoted uses the term “use of force or violence”. Clearly, the homeowner was legal (and within his rights, not the same thing) to use “force or violence”.

Does Louisiana law, elsewhere, distinguish “force” and “deadly force”? NH law does make that distinction, and although you CAN use deadly force in your backyard, fenced or not, to protect yourself or someone else you have a duty to protect, you cannot use deadly force (i.e., shoot someone) to prevent a property crime or to punish a property crime. The deadly force trigger is “imminent and unavoidable” threat as perceived by a reasonable person standard, with no duty to retreat.

So, in NH, this gentleman could be SOL. How about Louisiana?

Scaling an 8 foot fence to trespass into a strangers back yard at 2 AM and got shot. Justifiable shooting in Texas. No further questions asked and no charges for the shooter! NOLA isn't Texas, I see.

That’s exactly what I was thinking. This is probably going to be the new “shark attack!” meme for the rest of Obama’s term.

I’m sorry to say that, I know it sounds very snarky and I don’t want to make light of people getting shot, killed, or put on trial.

But the media was so out-and-out evil in the Zimmerman case that is really is impossible to trust them at all.

They boost Obama, that is their entire function now. News reporting and anything else they might once have done have all been cast aside.
