George Zimmermans attorney just called for the case to be thrown out.
I culd not understand why the defense took so long arguing for motion to dismiss.
He should have walked up and said “yer honor, the states entire case seems to be that a friend of the victim thinks she heard a voice in the distance over a cell phone call to 911 that she says sounds like trayvon, which is disputed by the another of the states own eyewitness who says it was Trayvon on top beating Zimmerman, who was yelling...” and THAT’S IT!!!... now can we stop this farce and let this poor man go home?”
Short answer is yes. The prosecution could appeal and if she was reversed there would be a retrial.
These motions are a formality and almost never granted.
I know it sounds counter-intuitive, but there are trials where the judge sees who is likely to prevail and starts protecting her record by making sure the side that seems to be losing gets all the breaks and has nothing to complain about in a motion for mistrial or new trial. A good example is testimony by the cop that Zimmerman seemed to be telling the truth. Even though the prosecution did not object at the time, she still granted their motion to give a curative instruction. Nothing for the prosecution to complain about or file a motion about.
Bottom line is if this jury acquits it's over. The prosecution has nothing to base any post-trial motion on.
Are there kangaroos in Kenya?
Of course dying men can stand. I have read Massad Ayoob state that even pumped full of lethal bullets, some people keep going.
The sound of one hand clapping. LOL
I’ve been saying it since the second day of prosecution witnesses, all of whom made Zimmerman look innocent.
It may be late, but it appears the finial verdict of the Civil War may have yet to be decided...
It’s just a procedural requirement, he doesn’t really expect it to be granted
Now this is funny! Made me laugh out loud. Good one!
Thanks 2ndDivisionVet.
” just admitted the version of the events can be open to interpretation”
That is code for social justice, relativity and jury nullification. The prosecutor just called for a jury nullification verdict for social justice.
It seems like the judge would rather have the case overturned than allow Zimmerman to go free on her say so. She is that scared of the minority backlash that she is willing to sacrifice Zimmerman and her future just to appease a bunch of racists.
“Only got a directed verdict once.”
I was a juror on a case where the judge said the jury would get it the next day. When we came in the next day he found for the defendant, and it never came to the jury.
He had his own personal recorder and recorded everything. Obviously he went over those tapes, and we never got the case. Had we gotten the case, we would have found for the defendant...it would have been a quick decision on the part of that jury in that case.
LOL! Then we need more like you.
