BEAVERCREEK, Ohio (WDTN) - The Federal Highway Administration's Office of Civil Rights says the City of Beavercreek is in violation of the civil acts right when it denied the RTA's request to add a bus stop near the Mall at Fairfield Commons.
The ruling states, "FHWA Office of Civil Rights, having examined the facts and the law, finds that LEAD has provided sufficient evidence to support its Title VI allegations that African Americans have faced discriminator impact as a result of the city's decision to deny the RTA's application to install bus stops along Pentagon Boulevard in the city."
The FHWA now recommends that the city develop and implement a new transit stop plan for which the RTA can resubmit it's request to the new bus stops.
The Ohio Department of Transportation will oversee the city's response and assist it in the implementation.
Beavercreek leaders must now re-hear the RTA'S application for the three proposed bus stops.
The Leaders for Equality and Action in Dayton (LEAD) first made its complaint about the bus stop denial in August 2011. It said the city failed to comply with the Title VI of the Civil Rights Act of 1964 (Title VI).
LEAD held rallies and flooded city meetings with their complaints, while the city said their decision was not based on race.

This may sound stupid but why does the freakin’ “Federal Highway Administration” NEED an “Office of Civil Rights”? More redundancy in the federal government. No wonder the country is broke.
There have been problems at some malls, at which minority youth arrive by public transportation.
It’s politically incorrect to say out loud. But, malls don’t want big numbers of ghetto youth scaring off regular shoppers, the kind of shoppers who actually buy things and keep the stores in the mall in business.
Anybody familiar with the Washington DC area years ago, may know what happened to Landover Mall. That mall went downhill and was eventually closed. And the reason was that the area around the mall was going downhill, and because critical masses of minority youth were hanging out and causing trouble.
I remember someone telling me they went to the movies at Landover Mall once, and it was the first and last time. They said that the youth talked and laughed out loud through the whole movie, and they couldn’t hear anything. And, the theater had rows of ripped up seats. One row of seats was no longer bolted to the floor, so the whole row became like a rocking chair or a swing to mischevious youth. It was a forbidding environment.
If malls get too many ghetto youth, they have trouble staying in business. It’s as simple as that. Legitimate customers will stay away.
Yes, I guess I’m also suggesting that these ghetto youth are not legitimate customers. They don’t buy much of anything, they just hang out and create a hostile environment.
The Office of Civil Rights is the enforcement group for several agencies. For example Health and Human Services has a group by the same name.
They go around auditing organizations for HIPAA compliance against a set of poorly defined regulations.
The proposed bus stops do not provide the solution for the problems that supposedly exists.
The complaint is that bus riders cannot safely get from the mall area to Wright State, the hospital, and the air force base, because there is no safe access over I-675. Only the hospital requires a stop near the mall, and it is several blocks away.
I live in an area that has bus stops. The new Walmart is not a safe place to shop anymore thanks to the bus route. Bus stops trashed the Dayton mall. That mall was forced to impose a curfew type rule requiring young people to be accompanied by an adult after 6pm to cut down on fights and other incidents of intimidation.
Yet another good reason to shop online.
There's no bus service to it, either. So the poo' folks (predominantly of a certain ethnicity) can't get there, either.

A new mall opened north of the city a couple of years ago. The owners were smart. They made sure there would be no public transit to this mall. Made some people unhappy, but too bad. The owners don’t want to see their new mall trashed.

Have the bus stops been placed at the Greene, yet?
Yep. Here in Jacksonville we have the Regency Square Mall. It's a ghost town. Pretty sad to walk through what was once a great place and see three shuttered storefronts for every opened one. A couple holiday seasons ago gunfire erupted between feral youths and an innocent kiosk worker got hit. That was pretty much the last nail in the coffin for Regency.

Don’t you wish that we could have honest plain speaking discussions of problems? In this case, the mall owners are blaming the economy for the problems. I’m sure that’s because it’s “politically incorrect” to blame ghetto youth for trashing the place or scaring away shoppers.
Imagine if the mall owners said out loud that these “youth” were causing problems. Eric Holder would be after them, and the IRS would also decide to do an audit.
Speaking of Eric Holder, he has lectured us that we don’t have honest discussions about race matters. Would Eric Holder like to have an honest discussion about race and the behavior of certain members of certain races?
So much for freedom of speech, freedom of association, and free enterprise. Forced integration is tyranny of the worst sort.
Actually, I like the idea of restricting rides to those who would be potential flash mobs. It was done in Minneapolis about a year ago to keep those who were potential “flash mobs” from getting easy access to the “Mall Of America”.
There was no gubmint actions taken back then, why now?
Ogden,UT lost a mall the same way. The gang bangers assaulted patrons and police were afraid to act. The mall failed, closed and was razed. A new mall arose a few miles away. Presumably out of range for the bad element that ruined the other mall.
Who knew anyone had a right to a mall bus stop?
Shop yes. The problem is some of the best restaurants are there, plus some stores that cannot be shopped online, like a Homegoods.
I honestly don’t know. We rarely go to that area. We are in the Fairfield area mostly for the restaurants.
