Slaton police came to this woman's house, who wishes to remain anonymous, to arrest her son. But by asking one simple question, she found herself behind bars instead.
"I told him, 'I will release my son to you upon viewing those orders.' Those were exactly my words," The complainant said. "He said, 'This is how you want to play?' He took two steps back, turned around to the officer and said, 'Take her.' They turned me around, handcuffed me, and took me in."
The complainant said she was aware police would be coming to apprehend her 11-year-old son based on a criminal complaint, and that she just wanted to see the warrant. As it turns out, that warrant didn't exist. She spent the night in jail while her son was left at home.
"He told me it was their duty to come pick up my son," She said. "Yet, I had someone stay the night at my house. They never came back that evening, they never came to pick up my son, or do what they told me they were there to do in the beginning."

1. That an 11 year old could rape. I'm sure it can happen, but it still troubles me.
2. I am reminded that anyone of us are innocent until proven guilty, and especially an 11 year old; the situation needed to be handled with extraordinary care. Not just a couple of officers.
3. What does the law say about rights and understanding those rights? How do you read Miranda rights to an 11 year old and make sure they are properly understood?
4. At what age do we treat children as adults? What if this boy was 9? 7? Also 5, the same age as the alleged victim?
5. What about justice for the 5 year old? How does that child get over what has happened?
6. The city should have seen this as a very big deal and initially allocated the correct resources to it, such as a psychologist or someone who deals with criminal children. Ideally, it would have been best to summon the mother and 11 year old to the police station to make a statement; with full written acknowledgment of everyone’s rights included. To those who say that would have cost the town more money, look at what this FUBAR will now cost them!

Until signed by a Judge / Magistrate that is a warrant APPLICATION not a warrant
If you tell a citizen you have a warrant, and ESPECIALLY a warrant for a MINOR, then you damn well better have a warrant in your possession.

I lived in NYC for 57 years and have lived rural for the last 12. I've lived my entire life avoiding contact with the police. IMO, NO contact with them will end up well for an honest citizen.
Yes. The department seems intent on compounding the error by not issueing an apology unless the woman agrees not to sue.
Bad strategy.
The Police done appreciate how truely vulnerable they are.They will piss off the wrong person with these tactics,and that person will go hunting.

I remember the first time I learned that just asking a policeman not to arrest you is “resisting arrest”, I couldn’t believe it.
Screw the apology. She them into bankruptcy. Demand they be prosecuted under 18USC242.
I would think that would be admissible in civil court as an admission of wrongdoing.
I write this hoping, like the brave woman in the story, that other Americans will step up to the plate and fight back through the courts.
It can be done..I did it and so can you..We are a Nation of Laws, use them.

I see it every day now in the news with people fighting back the right way, in a court of law.
We have had enough and the court room is where we will and have stopped you.
We the people now have the will and means to bring proof of truth to court with us. We..are not afraid of you anymore as proven every day in the new’s of corrupt government/law people losing their jobs and money.
I’ve seen first hand and a $100,000 (life savings and all I had, hocked) less later what happens when you stay in the fight. I was never taught to quit.
Here’s a list of those that lost their Job, or were forced into retirement after a fine, or got bad health, or all of of them together.
And all of this took standing in the gap, pointing the finger with proof and proof of truth in a court of law. Didn’t know you had to have proof of truth did you.
Stay the course or they, the bad ones will destroy you.
There is GOOD LAWMAN OUT THERE looking to help YOU.
If you stay the course, help will step in (State Law) but you HAVE got to prove you’re serious and YOU are telling the truth.
Get caught lying 1 time IN COURT and you’re out.
Go to jail during it and you’re out.
Here’s the list of the bad lawman that were forced out by their own above the law attitude, being exposed in a court of law.
I might add I had to finish the above and send them home jobless without using a lawyer. A couple of them were fined and went on to forced unemployment line later..to arrogant to take retirement.
They attacked me first. They were wrong and by God I STAYED THE COURSE and finished it. Got all my stuff back that was taken using the same courts (different judges) when THEY lost.
The list in my case..of those that are gone, not to bother We the People again in my area. I might add I live in the deep South so you can understand the hardship going into court..
This took a number of years to end I might add..
When you burn a bridge in something like this, down here you better burn that sucker to the ground.

SHE says they came to arrest the child. SHE says they refused to show an arrest warrant. Police do not need a warrant for an arrest in a felony.
Police can come to your door, just like anyone else. Since I wasn’t there, it would be nice to hear the other side. So far, only her story and statements from her mouthpiece (lawyer) have been quoted.
Let me offer an alternate scenario:
Police are investigating a rape of a child. Witness says, ‘I don’t know the kids name, but he lives in that blue house.’. Officer goes to the door and knocks. Woman comes onto the porch and starts screaming ‘F-you, F-you. I’m not telling you anything. I will sue your ass off.’.

She may have been detained as a witness. Who knows? Lots of people think they have been arrested when they have only been lawfully detained.
Maybe she thinks by creating a media storm, she can divert attention from her son.

Most police are being trained:
a) that all citizens are potential perps, and should be treated accordingly
b) that they must "take charge" of the situation immediately in order to minimize risk to themselves, so an attack on their authority or ignoring their commands is a direct threat to them
c) they are "highly trained" and civies are not, so that they should naturally be in charge and civies don't know what they are talking about, by default.
These attitudes are intentional and prevalent (and taught in the academy... I know this for a FACT). Add to this the massive affirmative action most police forces implement so that they can get the "right" number of women, et al., on the force, and you have the recipe for police misconduct. It's about the kind of people you look for (morally) and how you train them. Police have never made large salaries... but they weren't the same kind of people in the past.

Never talk to a cop. Get an attorney. Most cops will attempt to screw you. Avoid them, if possible. It is a sad state of affairs.
The police had absolutely no authority to even be on the woman’s property, let alone coming to arrest a minor child and I don’t give a crap about the reason for that either since it’s not germane to the abuse of authority and the extortion by the police.
There was no warrant, thus, no authority to be acting in that stead.
I don’t give a crap about their “side of the story”, the mother RIGHTFULLY questioned their supposed authority to be there and instead of walking away until they had the authority, she was arrested/incarcerated for daring to question them.
She’s just won the lotto, unfortunately, at the taxpayer’s expense. Now the taxpayers of Slaton should be demanding those jackbooted thugs be fired asap.

Are you serious? If a postman can come to your door and delivery a package, a cop can come to the same door. If a meter reader can walk onto your property, a cop can do the same.
Police do not need a warrant to talk to somebody.

What I am trying to say, and maybe I am not getting the message across, is MAYBE SHE IS LYING. Lets wait and get the facts before deciding if the police were right or wrong.
