BMW hit with discrimination lawsuit from EEOC

The U.S. Equal Employment Opportunity Commission announced a lawsuit against BMW on Tuesday, alleging that one of its facilities in South Carolina adopted a criminal background check policy that led to a disproportionate impact on African-Americans.
According to the EEOC, BMW switched contractors at its South Carolina plant in 2008 and instructed employees of the old contractor who had been working at the site to reapply with the new firm. This new firm was instructed to conduct fresh criminal background checks on all applicants.
...The result was that out of 645 experienced employees, 88 were denied rehire, including 70 blacks, the commission claims. That means 80% of those turned away were black, despite blacks constituting only 55% of employees.

Non-union plant; Obama’s EEOC attack dogs are suing. That CAN'T be a coincidence.
So true. We live in Florida. I may buy another car made from a non union plant when this one needs replacing. I try to do right on things I believe in but it's hard to with so much crap going on in all businesses with this unpatriotic ruler.

This new firm was instructed to conduct fresh criminal background checks on all applicants. They've gotta prove that a black with a particular record was turned down when a white with an identical record was hired.*That* could well be discrimination.Without such proof....no discrimination.

I obey the law and I get pulled over all the time (no probable cause other than the obvious) in my white neighborhood driving my BMW 5.
They should check me out first to see if I have broken any laws? /s

One of the big problems with these plants is tools and parts growing feet and walking out of the plant. A prior criminal record is one way to screen new employees to avoid theft.
In spite of their screening they still managed to find plenty of disadvantaged minorities to hire..so they should be give a medal..not a law suit.

It would seem that if BMW fired all of their non-black employees at the same time using the same criteria, no prejudicial behavior could be proved.

Agreed. The Feds recently settled a case in Minnesota over disparate impact. They know it won’t survive first contact with SCOTUS. Only good as a tool for the Jesse Jackson Hustle.

In the last two months, in all the Lunch-n-Learn trainings I've gone to, the EEOC has been warning that they were just waiting for the perfect test case to take this background check idea to court.
They put out a discussion idea about not asking about backgrounds until the second or third interview, and if a candidate has a background to take a solid look "one more time" before deciding against a particilar candidate.
They've been salivating to get their hands on a disparate impact case caused by background checks.
I loathe the EEOC.
