The family of the 7-year-old boy from Ann Arundel County elementary school who was suspended for making a gun shape out of a pastry has tried to clear the boys record.
This story made headlines across the country as the gun control debate has taken center stage among many elementary schools as some school administrators flex their muscles with a zero tolerance policy that excuses itself from common sense.
But according to the Baltimore Sun school officials denied the boys familys appeal on Monday, not allowing the boys record to be expunged of the incident.
Robin Ficker, attorney for Park Elementary School student Josh Welch and his family, said he will now appeal to the county school board.
Josh Welch was suspended in March for two days after school officials accused him of shaping the pastry into the form of a gun and waving it around, which was obviously a serious threat to everyone eating lunch around him.
The boys father was furious about how the entire situation was handled and how the school displayed a classic overreaction in their discipline of the boy.
When you compare the caliber of the offense to the caliber of the punishment, they dont match up, he said at the time. I just feel thats a lack of common sense in conjunction with the use of the rules and, honestly, I believe theres some personal bias involved in the decision, as well.
The family said it plans to appeal to the Anne Arundel County School Board.
The familys attorney said he has 30 days to appeal to the county school board and will more than likely do so this week.
Ive spoken to Mr. Welch, and were definitely going to appeal to the board of education, said Ficker, referring to Joshs father, J.B. Welch. If this school cant educate a 7-year-old without putting him out of school, how are they going to deal with 17-year-olds?
The school administrators are obviously pedophiles into sado masochism ~ they should be hauled way for observation, and then trial.
Forget the appeal process, just sue them for mental abuse, harassment, stupidity or whatever they can think off.

This country has officially gone insane. I remember the days when kids used to play with super soakers outside, play cops and robbers on the streets..now you can’t even have a pastry without leftist freaks accusing you of using it as a weapon
How about the locals paying school taxes? Shouldn’t they have a say in how, or even if, this should be handled?
They’re paying the freight and should stand up and be counted. I certainly would.

I hope the School Board people are elected. If they screw this up, they are toast, I would hope. But in Baltimore, you never can tell.
Withdraw the boy from the school and either homeschool or go private school.

You said it. I graduated from middleschool last year and now I’m a freshman in highschool. But after the school shootings, and despite the fact that I am my schools alumni and that I had nowhere on my person to hide a weapon of any kind, they won’t even let me visit my old teachers. I still have a copy of the constitution to give to my social studies teacher...
Caliber is merely a vocabulary term, I see not the logic of suing him over the use of a word, unless you have a reply?
