Family Of Man Killed During Urban Beach Week Files Suit

The family of a Boynton Beach man who died in a hail of police gunfire on Miami Beach two years ago over Memorial Day weekend filed a wrongful death suit against Miami Beach and cities whose police officers were involved in shooting.

The shooting took place around 4 a.m. on May 30th, 2011. Police said Ray Herisse, 22, was driving erratically and tried to hit an officer with his car on a crowded Collins Avenue when they tried to pull him over.

“There was an indication he may have been driving under the influence. But if it is Miami beach’s policy and Hialeah’s policy to execute people in Miami Beach while we have a festival in town for driving under the influence, we are going to have a whole lot of dead tourists here,” according to Marwan Porter who is representing Herisse’s mother, Marceline Azor.

I can tell you there is a lot of lawlessness in Miami Beach on Memorial Day weekend....cops there have to deal with a lot of BS.

WHETHER they violated civil rights? I tend to think not....but of course the media will hype this....

All cop cars have video....so the video will clear up a lot. If this perp was drunk...then the LEOs are in the clear.

Heck its dangerous driving in Dade County when sober...much less drunk

DUI or not, assault with a motor vehicle is legally, and rightly so, classified as 'Assault with a deadly weapon'.

Records show police fired more than 115 rounds. Herisse was shot 16 times, according to the Medical Examiner’s report released earlier this month, and died on the scene.

Four bystanders were also wounded in the shooting.

Now, what would have been the result if a bunch of “civilians” had fired 115 rounds, even in a clear self defense or defense of others situation, and hit four bystanders?

The police need to be held to the same standard.

There was a video of this shot by someone on a balcony looking down onto the street. If I remember correctly (looked and couldn't find it) the car was in a chase with another car (not police) and then stopped at an intersection. The police opened fire at that intersection. People were running in all directions.

At the time, it appeared to be rival gangs chasing each other through the crowded streets during the party weekend. This situation plays itself out at all of these urban festivals, I'm not going to second guess the cops here. With gangs you never know who's on what side and where their people are. Unfortunately, these events have a history of getting violent and I'm sure that was on every cop's mind.

A sweeping generalization. Why not volunteer to ride along with your local PD on the weekends and request to ride with a unit that patrols the problem areas of your city. Let us know what you find out.

In reading the story there appears to be a lot of questions unanswered.
I'm not saying the guy is "innocent"...but I am saying this looks hooky on a number of levels.
Opening massive fire and hitting non-involved bystanders, alone, makes it look like a bad shoot.

You think not?

115 shots, they kill an unarmed man in a stopped car and wound 4 innocent bystanders. What are you thinking? Why would you shoot at someone who is not a threat? Why would you shoot 115 times. Why would you open fire in a crowded area. Do we shoot drunk drivers?

My son is a cop. So if you think I am being hard on cops or a cop hater you are wrong.

Cops have a job to do. If they are so afraid of doing their job that they kill people needlessly they need to get another job. If they kill innocent people they need to be punished. If a bunch of us would have killed a cop by shooting him 115 times because we thought he was driving erratically and because he had a gun and might have shot it we would all be on death row by now.

They killed him because he was a young black kid acting like a young black kid. It is wrong pure, plain and simple.

I hope the people of Miami have to pay until it hurts. It is the only way to make them clean up their act and get rid of the bad cops.

There is simply no excuse for taking this kids life, none. /p
