A federal judge said this week that the Obama administration is likely violating the law by telling immigration agents and officers not to arrest illegal immigrants they deem low priority, in a case that could upend President Obamas enforcement policy.
For the last several years the administration has said it will no longer arrest most illegal immigrants, arguing it wants to focus only on those with serious criminal records or gang ties. The Homeland Security department said it was using prosecutorial discretion.
Immigration agents and officers sued, saying federal law requires them to make the arrests, but the Obama administration would discipline them if they complied with the law.
Federal Judge Reed O'Connor said in a court order Tuesday that Congress, not the president, sets priority for arresting illegal immigrants, and said the law requires them to be put in deportation proceedings.
The court finds that DHS does not have discretion to refuse to initiate removal proceedings, Judge O'Connor wrote.

Unless it goes to the Supremes law breaker 0bama couldn’t give a crap.
I have always distrusted that program as setting them up for disaster. I know some illegals who were raised in the US since infancy and are thoroughly integrated, and I warned them that this could not be trusted, that the current government is as unethical and treacherous as it comes, and with all the information they were providing it would be a breeze to scoop them up in their hundreds of thousands.
None of them believed me, however. The hope to be able to live without constant fear of arrest was too great.
They are really caught between a rock and a hard place, as they have no way to establish Mexican identity, no papers, no family or connections in Mexico, and at least three or four of them have no memory of Mexico at all. It is, in all respects, a foreign country to them.
He is il Douche.
Outstanding!
"A thousand cuts" is another.
Finally a voice of sanity in that madhouse!
This will be largely ignored by the regime, just like those unconstitutional recess appointments nobama made.
The man feels he is all powerful, nothing can stop him and he can ride roughshod over the Rule of Law as it suits him.
This cannot continue.
I do not understand why so many on this site get excited about news like this. They will just ignore the judge and continue to do as they please. Why? They know there is no one in the Republican Party that will utter a word in protest, and if 1 Republican happened to do so they would unleash the press on them.
Now go after all our outlaw mayors and governors.
>>I cant figure out what took so long for a federal judge to come forward and say this, its the law.<<
This was Boners job to say that Zero doesn’t have the authority to change the will of Congress. ICE should not have had to go to Court.
Wake up House of Reps GOP! Obama took your Constitutional powers and this Judge just gave you a huge push to stop it.
“A federal judge said this week that the Obama administration is likely violating the law”
Hahaha. Likely violating the law...
Whether the Federal employees in black robes think their appointing master is violating the law or not he’s certainty ignoring the law.
Disaster? I believe you know more true illegals, than anyone on this forum. Treachery is the fine art, of humble dissuasion. Dissonance echo’s hollow, pal. Know much about sonar?
And there it is. Great shot!
:: will he issue a contempt of court citation and arrest warrant ::
Only problem with that is that such vehicles would be executed by the executive branch (Holder).
First one in a LONG time.
Ya think? Arizona is about 33% Hispanic, almost entirely Mexican. About 14% of the state are foreign born, legal and illegal. Guess what nationality? All but a tiny number were born in Mexico.
If you see someone who looks Mexican, if you know them as a friend or somebody you do business with, and they trust you, they may tell you about the status of members of their family. Surprisingly few families in Arizona are all legal or all illegal. More like (this is a real case, but I’m not entirely clear on all the details, but this is mostly accurate):
“Grandmother is legal, but she doesn’t speak any English. Grandfather was illegal, but died here 20 years ago, both of their sons were born American, but one married a Mexican illegal. Two of their kids were born here, and two in Mexico. The two who are illegal were raised here and have never been to Mexico, and aren’t very good with Spanish so have a hard time talking to Grandmother. We used to have a cousin in Mexico but they died so we don’t have any relatives left there.”
Other states (all data US census):
Texas, 38% Hispanic, 16% foreign born.
New Mexico, 46% Hispanic, 10% foreign born.
California, 38% Hispanic, 27% foreign born.
Surprisingly there are likely many FReepers who know illegals and do business with them, likely without knowing they are illegals, or have family here who are illegals.
In fact, I have no idea if you are a legal citizen.
