North Dakota lawmakers who approved what would be some of the most restrictive abortion laws in the U.S. are now considering outlawing all abortions.
The personhood measures would ban abortions by defining human life as beginning with conception. Its drawing opposition from some doctors who say it could cause problems for infertile couples seeking to use in vitro fertilization to conceive, but supporters insist thats addressed in the legislation.
The state Senate passed two personhood measures last month, and the House could vote as soon as Tuesday. One of the bills would make the proposal a state law and another is a resolution that would put the definition into the state constitution, if passed by voters.
North Dakota is one of several states with Republican-controlled Legislatures and GOP governors that is looking at abortion restrictions, but the state is could go further than any other in challenging the U.S. Supreme Courts 1973 decision that legalized abortion.
Aren’t such laws pointless and certain to be overturned because the right to an abortion is now Federally protected via Row v. Wade?
If I remember correctly, there is only one abortion clinic in the whole state, in the Koppleman building in Fargo.
Catholic friends of mine used to go “counsel” the women who would go there.
I’ve always thought that if abortion law was left to the states, North Dakota would outlaw it, and California would mandate it.
I have always thought that a TAX on abortions was the way to go.
That tax should compensate for the future tax revenues that child might have produced.
The TAXING power was just upheld in Obamacare, right?
It will be interesting to see when the Holder’s Justice Dept. gets involved and tries to trample States’ rights even further. This could set up a protracted battle between the two.
The North Dakota legislature has always been pretty conservative and such measures have always garnered lots of support. If I am not mistaken, sometime between 1985 and 1993 the legislature passed a very restrictive abortion law only to have it vetoed by the Democratic Governor George Sinner. Appropriate last name perhaps. Sinner is a Roman Catholic with 10 kids.

Maybe not. Thomas, Scalia and Alito would almost certainly vote to overturn Roe v. Wade. Though he sold us out on Obamacare, Benedict Roberts is supposedly very pro-life, so I think we can count on his vote.
That leaves Kennedy, who the only one who could be consideraed a “moderate” on the court. He voted to uphold the partial birth abortion ban, so their is a chance he’d give us the 5th vote.
I am more optimistic that Kennedy might the North Dakota and Arkansas bans based upon fetal heartbeart. While we know life begins at conception, it should be clear to any thinking person that a human being with a heartbeat is not merely a “clump of cells”.
This is going to backfire when the courts further reaffirm Roe vs Wade.

I have often wondered why it has taken so long for some conservative state so long to just do this and force another challenge of the constitutionality of Roe v Wade. That whole “right to privacy” bs should have been challenged many moons ago.

They all say that, and it make no sense. If abortion is so awful that they would never choose one, why is okay to make it available to others? Situational ethics, I guess.
