Mark Gaston Pearce, chairman of the National Labor Relations Board, issued the following statement in reaction to todays DC Appeals Court decision that President Obama use of recess appointments to install three people on the NLRB last year was unconstitutional. The action renders the board without a quorum to act and potentially invalidates a years worth of actions and rulings by it. Pearce indicated that the NLRB will attempt to continue on regardless:

When is Obamacare getting back to the Supremes?
I imagine that the HHS birth control/abortion mandate will end up in the supremes, since three out of four judgements have been against ObamaCare.
The ruling is only the first step. The appellate court can, upon motion, issue a writ of prohibition directed to the NLRB, which would render illegal all of their actions, violation of which would lead potentially to criminal contempt and jail.
You are going to see a flood of litigation now.
If I were a litigant at the NLRB, I might also start filing disbarment petitions with the appropriate bar disciplinary boards against any government lawyers complicit in intentionally violating a valid court ruling.
Some company needs to bring suit. Who has standing out there to sue the NLRB which is an illegal cabal at this juncture. I am sure Landmark Legal will join in.

And I seriously don’t know ... for all the reasons you stated (which is why I was ‘half joking’ although I think that is what the Usurper & The Mooch deserve).
Insofar as this & Roe v. Wade (RvW) is concerned, not really -- RvW is a Supreme Court overreach, and invalid for several reasons, one of which is that the Constitution guarantees the States have a Republican form of government. RvW is a violation thereof because, with one magic ruling, the USSC deemed that it could render [many] State laws invalid, not because they were in reality unconstitutional, but by making up a "right to privacy" (which is oddly nowhere to be found in cases concerning the War on Drugs) and saying that such right is infringed upon by the State prohibition of abortions (conveniently ignoring the mandate that States offer equal protection under law to its citizens, presumably even the unborn) -- arguably this decision is far more constitutional than RvW.
This part of the Administration is issuing fighting words, while another part is pushing to take away our Right to own firearms.
These are the green shoots of genuine tyranny.

One private dollar wasted in the process is enough harm for me.
Waste and friction are a necessary part of "the process," be it political, legal, or simple living. No waste? No feedback.
If the court had ruled the other way, then the money spent fighting the decision would be called "waste."
Going forward, this decision crystallizes legal arguments. Those who oppose NLRB rulings now have easy work.
Fox White House correspondent, Ed Henry, (formerly of CNN), should have corrected poofter Shepard, but he didn’t. I also happened to see that segment, quite by accident. The TV was left on unattended in the kitchen. I NEVER watch Shepard Smith.

The constitution contemplates the political remedy of impeachment and removal from office. Not that Congress will do its job - it’s failed miserably on that count, in many ways, for as long as I have been alive.
And just how will they remove him? They don’t have an army to go into the WH and drag him out.
