Wyoming lawmakers propose bill to nullify new federal gun laws
January 10, 2013 | 11:03 am 202Comments Charlie Spiering Commentary Staff Writer The Washington Examiner
Wyoming lawmakers have proposed a new bill that, if passed, would nullify any federal restrictions on guns, threatening to jail federal agents attempting to confiscate guns, ammunition magazines or ammunition.
The bill HB0104 states that any federal law which attempts to ban a semi-automatic firearm or to limit the size of a magazine of a firearm or other limitation on firearms in this state shall be unenforceable in Wyoming.
The bill is sponsored by eight Wyoming state representatives ad two state senators. If passed, the bill would declare any federal gun regulation created on or after January 1, 2013 to be unenforceable within the state.
In addition, the bill states would charge federal officials attempting to enforce a federal gun law within the state with a felony subject to imprisonment for not more less than one (1) year and one (1) day or more than five (5) years, a fine of not more than two thousand dollars ($2,000.00) five thousand dollars ($5,000.00), or both.
The bill also allows the Attorney General of Wyoming to defend a state citizen from any prosecution by the United States Government.

In contrast to the Colorado governor calling for more gun control.
That would be the show of a lifetime.
My guess is Justice would take it to court and try to get a hold put on it.
is one of the southern states defying the Bush/Pelosi light bulb manufacturing ban?
Maybe this is the first volley in the next “Civil War”?
Boo-rah to Wyoming.
Gotta force the pansy Dem governor of Montana to do same.
This is a strong offensive slap in the face to Obama, he is the Red Queen that will not tolerate dissent against his Wonderlands policies.
Even if not on a state wide level we are obligated to defend our communities in the same fashion, to have at the ready 24/7 people who will be able to perform a 2A citizens arrest upon any gun grabber.
A four man grabber team hits a neighborhood, word gets out, they are then subjected to an escort out of that community or to be detained as enemy combatants.
Why is time wasted on blatantly Unconstitutional laws? There are SO many ways to promote, and protect, gun rights that will ensure those rights for us and all I see are idiot State level proposals and lunatics on TV screaming.
And we wonder why we are getting blitzed at the polls and only have one demographic that supports us.
I am tired of watching morons try to protect my rights. Standing there screaming like a 2 year old will ENSURE that I lose my rights.
This is flat out stupid.
It is my understanding that the unrestricted right to bear arms was a pre-condition for Montana to join the United States
How Will They Confiscate Your Guns?

For decades I have heard gun owners claim that the government would never be able to confiscate our firearms because the government would lose too many men. The implication being, of course, that gun owners would actively resist confiscation, even to the point of shooting back. But I believe this thinking is outdated and doesnt align very well with reality. But before you tell me how big your honor guard in Hell will be when that day comes, lets think about how the government could really do it.
Suppose, for the sake of argument, the government bans all civilian possession of firearms at the end of this month. Congress passes a total ban and the President cuts his own re-election throat by signing it. Gun owners get some grace period to turn them in, even beyond the deadline, without being charged with a crime. If we use Australia and Britain as examples there will still be a significant number of firearms that are not turned in. Some estimates put the Australian turn-in at less than 25% and the British faired only about 28%. But Australians and the British have long been used to obeying almost every gun control law. Not so the Americans. When laws are passed that we dont like, we bite. We scratch. We vote. So here we sit after the guns have been collected and the amnesties have run out. Now what? Send out the personnel carriers, swat and shock troops to seize the guns from those militia terrorists who refused to turn them in? Dont be silly.
The government has lots of records about you. If you purchased a firearm since 1968, chances are that they have some record of it somewhere. Most likely, it will take quite some time for them to compile all the serial numbers of surrendered guns (surrendered essentially at gunpoint) and cross off the ones you turned in. Itll take more time for them to attempt to clean up their data. Say, about two years, maybe three. Add to that the hordes of people keypunching in hundreds of thousands of sales and registration records from hundreds of gun stores forced out of business. At some point the government decides they have something approaching a good database of unaccounted-for guns.

Patriots can store their guns in warehouses, patriot armories, in WY. So folks in CA, NY, IL know they can legally keep their semi-autos. There also will be plenty of space for practice.
Your point was that if Brewer had defied the SCOTUS decision on AZ immigration law it would be up to justice to enforce it somehow? assuming the court make up penalties for defying it like fines?
Example : They could fine them but have no way to enforce it except send in FBI ?
It certainly sounds like it would be the show of a lifetime.
Who says they have that as a immediate goal, or need it??
If they pass a law banning assault rifles again (after taking back the House) then they will no longer be made here.
If it also says we must turn them in then we are made into criminals having to hide our guns, while illegals are given amnesty by O (until a Dem House passes that too) with all our rights and benefits as Dreamers, so now the classes have been flipped.
That is doable some time in the future (not now because they dont have the House) and it flips right and wrong 180 degrees.
Aahmmm.....
“Wyoming lawmakers propose bill “
As I read the post, there is no law yet
Like a lot today, it sounds good but the Left is much better at rewriting history than conservatives.
I did not know that.
Will have to do some checking.
I remember that the Montana Firearms Freedom Act took effect in 2009, declaring that any small-caliber firearms (excluding full autos) manufactured and sold within Montana cannot be regulated by federal authorities.
Of course the ATF jumped on that and the matter is making its way through the courts.
So many liberals for California have moved to Colorado that it is no longer a free state.
Found this Constitutional article listed, including the rather odd mention of conceal carry permits:
“Montana: ‘The right of any person to keep or bear arms in defense of his own home, person, and property, or in aid of the civil power when thereto legally summoned, shall not be called in question, but nothing herein contained shall be held to permit the carrying of concealed weapons.’ Mont. Const. art. II, § 12.”
The CC portion has to be a relatively recent addition. And whatever it means, I know personally that acquiring a carry permit is a county-by-county matter, and in many counties (excluding those where the rich lefties have taken over) the process is wonderfully simple.
