Republican Rep. Allen West‘s campaign says it filed a request for an injunction late today ordering St. Lucie County Supervisor of Elections Gertrude Walker to conduct a recount of all 37,397 ballots from early voting rather than the 16,275 ballots the county canvassing board decided to recount Sunday.
A copy of the filing wasn’t immediately available.
A partial recount of early votes on Sunday showed Democratic challenger Patrick Murphy losing 667 votes and West losing 132 — a net gain of 535 votes for West that reduced Murphy’s small lead in the congressional District 18 race.
“It stands to reason that if the remaining early votes were to be recounted, additional errors would be uncovered and the tabulation of votes revised accordingly,” a statement from West’s campaign said. “Until these remaining early ballots are recounted, however, the Canvassing Board has arbitrarily applied differing counting standards to similarly situated ballots. The erroneous decision of St. Lucie County to ‘re-feed’ only some of the early votes cast in this election violates the Florida Constitution’s guarantee of equal protection to voters.”
Earlier in the day, Secretary of State Ken Detzner ordered three representatives to St. Lucie County to observe and report on the elections process there. St. Lucie, Martin and northern Palm Beach counties make up District 18.

Congressman Allen West, along with eight other named plaintiffs who were early voters in St. Lucie County in Florida, filed a complaint today in Circuit Court in St. Lucie County. The complaint asks the Court to immediately issue a preliminary injunction ordering Defendant Gertrude Walker, as St. Lucie County Supervisor of Elections, and Defendant Dan Detzner, as Florida Secretary of State, to convene the St. Lucie County Canvassing Board for the purpose of counting all votes cast in the election for the 18th Congressional District during the early voting period, and ordering Defendants to refrain from certifying results of the election for the 18th Congressional District until all ballots cast during the early voting period have been counted.
The St. Lucie County Canvassing Board met on Sunday, November 11, 2012 for the stated purpose of recounting all ballots cast during early voting. This refeed was not conducted pursuant to Floridas automatic recount statute, but rather as part of the canvassing process. The Canvassing Board, however, re-fed only ballots cast on three days during the early voting period. This limited, partial re-feed not conducted pursuant to any statute uncovered significant errors in the initial tabulation of votes. Nearly 1,000 votes disappeared from the count, and neither the Canvassing Board nor the Supervisor provided any explanation for this selective recount. Despite publicly announcing a hearing for the purposes of re-feeding all early votes, counsel for the Canvassing Board advised publicly that Tallahassee recommended counting only those specific three days all without providing information as to who advised a selective re-feed or the basis for doing so.
It stands to reason that if the remaining early votes were to be recounted, additional errors would be uncovered and the tabulation of votes revised accordingly. Until these remaining early ballots are recounted, however, the Canvassing Board has arbitrarily applied differing counting standards to similarly situated ballots. The erroneous decision of St. Lucie County to re-feed only some of the early votes cast in this election violates the Florida Constitutions guarantee of equal protection to voters.
In addition, the County has violated both the Florida Open Meeting Law, Florida Sunshine Law and the Florida Constitution by meeting behind closed doors and without providing the required notice to the public.

ST. LUCIE COUNTY While state elections officials said Tuesday they had expected a full recount of all the county’s early votes, county Supervisor of Elections Gertrude Walker said in a press release that state officials told her only the last three days of affected early votes could be retabulated.
“While I desired to do a total retabulation of all early voting ballots and noticed it as such, after consulting with the Division of Elections, I was advised that only the affected ballots could be retabulated,” she wrote.
Walker has scheduled a press conference at 4:30 p.m.
On Election Day, the elections office had problems uploading electronic memory cards with voting results from Nov. 1-3, after old cards were replaced with new cards so as not to overload them.
The Division of Elections spoke to Walker about the issue Saturday and was under the impression the countys canvassing board would recount all 37,379 ballots cast during all eight days of early voting not just the three days the Canvassing Board decided to recount on Sunday, according to Department of State spokesman Chris Cate.
The state will send three employees to the St. Lucie office Wednesday to determine how 799 votes disappeared in Sundays partial recount of the close, nationally watched congressional race between U.S. Rep. Allen West and Democrat Patrick Murphy.

My personal theory is early voting fraud. ...
I voted early in Indiana. The ballots are not put into a machine for auto counting. They are put through a slot in a cardboard box.
How do I know my vote was actually counted???
Is there any way to find out?

What is proof of how rotten Florida’s system is after Holder and pals kept it the old way is folks who have not registered since 2003, and; they received notices in other states. So, Florida lets these clowns vote from another state. Yes, they have snow bird types who own northern plus Florida property. That does not give them the right to vote twice.

This is just sloppy vote fraud. How do you do a recount and wind up with 799 fewer votes. The poll workers are supposed to be filling in those ovals not erasing them. They are supposed to be finding more ballots not losing then.

They certainly are. The TV news anchor characterized the crowd as “rowdy” then handed it off to the on-site reporter.
The crowd was well behaved and orderly.
If that crowd is “rowdy” then this guy is afraid of his own shadow. He probably sleeps with a teddy bear.

The big problem is all the extra time before election day the Rats have to go into nursing homes, skid row, prisons etc. and manipulate hordes of people to vote. Not to mention invent false bios of hordes who don't exist.
Sure Repubs could do it too but the generally don't like those sleazy tactics of forcing the unaware to vote when they wouldn't under normal circumstances.
