GOP sues to force Obama compliance on Fast and Furious
The Washington Times ^ | August 13, 2012 | Stephen Dinan

House Republicans on Monday asked the federal courts to intervene and force the Obama administration to turn over documents from the botched Fast and Furious gun-walking operation, escalating what had been a simmering constitutional crisis.

House Speaker John A. Boehner said President Obama and his team were ignoring a congressional subpoena — something the courts have long recognized as valid — and said lawmakers were left with no choice but to ask the third branch to referee.

“By stonewalling Congress and ignoring a contempt order, the Justice Department has left the House no choice but to take legal action so we can get to the bottom of the Fast and Furious operation that cost border agent Brian Terry his life,” Mr. Boehner said.

Terry was killed in December 2010 in a gun fight with bandits who had crossed the U.S.-Mexico border. Two of the weapons recovered at the scene were part of Fast and Furious, an Obama administration operation that was supposed to try to track guns being sold to Mexican cartels, but which lost track of the weapons, allowing thousands to stream across the border.

But House Minority Leader Nancy Pelosi, California Democrat, rallied to the administration’s defense, saying the GOP push was misplaced.

“This partisan lawsuit wastes taxpayer dollars and resources, and is a distraction from the urgent business before Congress: acting to create jobs and grow our economy,” she said.

“This partisan lawsuit wastes taxpayer dollars and resources, and is a distraction from the urgent business before Congress: acting to create jobs and grow our economy,” she said.

Pelosi's statement is not only hypocritical but laughable.

Hey Nan, unlike obamacare this is a matter we really do have to see before we know what's in it.

Hah, and is anyone as Obamadumb as to think that Holder’s “MyPeople” department of felon/idiots is going to do anything about that lawsuit?

Hey Nan, how about allowing the courts to force Holder & Obama “to pass it...over” so that we can find out what’s in those subpoenaed docs?

For sure the DOJ thugs will not comply but this is a suit filed in federal court. If the judge finds against Holder and he doesn’t comply he could go to jail until he does. Doubt it’ll happen but it’s a good feeling to think he might, he’d look good in stripes.

Ha, Dems were floating “Romney is a potential felon” as a campaign issue. Now they’ll have to defend the most corrupt admin in the history of our nation.

Once the court rules on behalf of the House let Obama & Holder still not allow the release of those documents before November 6th.

Obama risks dragging down the entire DNC in November (2010 was just a warm-up)!!!

Who is paying for Holder's lawyers?

Sorry, Pelosi is right. If Holder ain't paying personally, this means nothing except it will cost US!

Holder will respond only when it either means criminal actions against him or costs him a LOT of money.

If neither of these things happen, R's are, as they say, pissing in the wind.

Doesn't Pelosi want to force compliance so we can see what's in it?

She also repeated her claim that Republicans are using the fight against Mr. Holder in retaliation against his own push to halt GOP-led state laws designed to crack down on voter fraud.

Nancy and Eric firmly believe that freedom to commit voter fraud is every democrat's civil right.

Yes, it'll cost taxpayers for the suit. From what I've read in the last couple weeks the precedent has already been set and Holder will lose this suit. The last step of noncompliance thus resulting in contempt of court on his part will subject him to jail until he complies.

Don't know how it will turn out but it'll be interesting to watch.

I was afraid of this:

"While the Committee is entitled to all documents responsive to the Holder Subpoena that have not been produced, the Committee seeks in this action to enforce the Holder Subpoena only as to a limited subset of responsive documents, namely those documents relevant to the Department’s efforts to obstruct the Committee’s investigation."

This means Issa is more interested in the coverup than the "what did you know and when did you know it" phase of F&F. I don't understand that. This was almost certainly a WH/Holder hatched scheme and Issa seems be avoiding looking into that possibility like the plague.

The civil case is first, pushing for release of the requested docs so that a thorough discovery can take place. Then after Romney is installed with a new US AG in Jan ‘13 the criminal case can be built and pursued against these felons.
