Woman hit by ball sues Little Leaguer

A New Jersey woman who was struck in the face with a baseball at a Little League game is suing the young catcher who threw it.

Elizabeth Lloyd is seeking more than $150,000 in damages to cover medical costs from the Manchester Little League game two years ago. She's also seeking an undefined amount for pain and suffering.

Lloyd was sitting at a picnic table near a fenced-in bullpen when she was hit with the ball. Catcher Matthew Migliaccio was 11 years old at the time and was warming up a pitcher.

Anthony Pagano, a lawyer for the Migliaccio and his family, says the lawsuit is "frivolous" and "disgusting."

You’re in the U.S. of A. And lawyers gotta make a living. Doesn’t cost anything to roll the dice, so why not head on in to the casino?

Gotta wonder about that throw, though, unless the woman was sitting between home plate and the pitcher’s mound.

if he didnt’ do it on purpose, this woman has issues, adn shoul dn’t be iat a baseball game if she can’t pay attention to teh world around her

The lawsuit is frivolous and disgusting. The law firm has no morals, the mother has no sense of personal responsibility . . . and the lawyer missed a bigger target. Why not sue the much richer company that made the baseball, since the Nerf Company has proven it's possible to make a safer ball and the company that made the dangerous ball was "negligent" in producing a real baseball?

Did some googling on the story. Mark my words, before this is over, the catcher’s family will be suing the league.

I did on a lawsuit case and I did it successfully. When I let my views be known about who was responsible about the housing crash, I was the first dismissed.

There’s not enough information in the article for me to figure out the angles involved. Was the kid throwing in a direction he should have been, or what ?

The judge that allows this to proceed needs to have the baseball and bat rammed up his rectum.

I've only been called for jury service once in my life and I made no effort to avoid it. We get OJ juries because there are too many OJ jurors out there. To avoid such juries we all need to be willing to serve.

I agree. The kid is responsible and absent any insurance to cover her costs, should be required to pay out of pocket. Additional damages may have been thrown in to motivate the kid’s family to settle out of court.

It says he was warming up a pitcher so most likely they were over on the sideline.

From what I’ve been able to glean from other sources, the kid overthrew the pitcher, which would put her at a picnic table behind the pitcher’s end of the bullpen. Not the best place to encourage people to sit I guess.

Presumably, she has no health insurance or they refused coverage (a big presumption, but it makes sense given that she’s seeking recompense elsewhere), so she’s stuck with the tab for the re-constructive surgery. She attempted to negotiate with the insurance company involved (again, assuming it was the League’s insurance company), but they said, “hey, not our problem”. The League itself is saying the same thing. Now it might not be right to sue the kids family, but it sure makes financial sense.

I believe that my state of Colorado has a law which provides specific legal protections against lawsuit in the event that someone attending receives an injury at a sporting event.

Nope, you sit near a baseball field while kids are playing you are assuming the risk of being hit by the ball.
