You’re in the U.S. of A. And lawyers gotta make a living. Doesn’t cost anything to roll the dice, so why not head on in to the casino?

Gotta wonder about that throw, though, unless the woman was sitting between home plate and the pitcher’s mound.

if he didnt’ do it on purpose, this woman has issues, adn shoul dn’t be iat a baseball game if she can’t pay attention to teh world around her

The lawsuit is frivolous and disgusting. The law firm has no morals, the mother has no sense of personal responsibility . . . and the lawyer missed a bigger target. Why not sue the much richer company that made the baseball, since the Nerf Company has proven it's possible to make a safer ball and the company that made the dangerous ball was "negligent" in producing a real baseball?

There’s not enough information in the article for me to figure out the angles involved. Was the kid throwing in a direction he should have been, or what ?

She assumed the risk by being near the game of baseball. If she wanted a relatively riskless activity she should have gone elsewhere.

This is why tickets to ML baseball games have the warning on them that they are not responsible for anyone hit by a batted or thrown ball.

According to the story, the woman was not at the game. She was at the park at a picanic (as Yogi would say) table. Besides, her beaning wasn’t even part of the game. It sounds like a couple of kids who weren’t in the game, started goofing around and the lady was hit. Kids guilty- pay the lady.

The woman was at the game to watch her son - she was not just having a picnic nearby as some have theorized.

She is not suing for compensation for an accidental injury, she contends that the boy deliberately hit her with the ball and she is seeking $500,000. Her husband is also suing the boy for the loss of “services, society and consortium” of his wife. They have been sending “angry letters” to the boy for the last two years. They have demanded a jury trial.

Just a few more facts to consider as you form your opinions about the case...
