Tombstone, Arizona (CNN) -- The six Forest Service rangers suddenly crouched, whispering, on their way up the rocky mountain trail. It was early Friday afternoon, the first day of the Tombstone Shovel Brigade, and the rangers were out in force, hiking to the spot where dozens of volunteers worked with picks and shovels to move and bury Tombstone's makeshift water line.
Shhh! Look! Do you see it?
The rangers stopped in their tracks. Binoculars emerged from pockets, and fingers pointed to a stand of trees.
And there it was, a Mexican spotted owl, perched high in a pine tree. It was a male, the rangers said, with his back turned to the intruders. He scratched and preened. But mostly, the owl seemed to be watching the nest in a nearby sycamore tree where his mate tended to an owlet.
The owl is a threatened species, and until a few days ago its presence in fire-scorched Miller Canyon was a matter of speculation. But now that it has surfaced, the owl could be a game-changer in the water war between the U.S. Forest Service and the Wild West city made famous by the 30-second gunfight at the O.K. Corral.
Tombstone is trying to repair a 26-mile pipeline that has brought mountain spring water into the city since 1881. It was damaged during last summer's Monument Fire and monsoon rains that brought mud, water and boulders crashing down the denuded slopes...
With the conservative Goldwater Institute taking on Tombstone's legal work, the court battle has blossomed into a full-blown states rights dispute. Tombstone is getting the attention of activists from Utah, New Mexico and other Western states who say the federal government has gone too far. It has become ground zero in a rekindled Sagebrush Rebellion.

Saw a gopher launched into the air in at least one of the kabooms.
You forgot the magic French word to make the Poulan go.
Teeeeeem-bearrrrrrrr! (cf the Lumberjack in Pink Panther cartoons)
Yup. I bought the Poulan on sale. Was a great deal, but then didn’t use it right away. It sat in the box past warranty, and then when I needed it like yourself couldn’t get the danged thing to start. Took it to a repair shop locally, and had the carburater serviced. It would start after that, but wouldn’t continue running. Rather than put another nickel into that piece of junk, I bought an ECHO, and have been sawing away ever since.
I noted the model Poulan I had on sale at giveaway prices at a major tool store for awhile, but then they disappeared.
LOL! My son used to plant fireworks with long fuses in all the gopher holes, but all that did was drive them into a neighbors yard until he did something similar.
Spectracide works wonders. Just apply it with a spreader and kill the grubs that the gophers are feeding on. Heck, you have a right to protect your lawn from the grubs.
Spotted Owl - Endangered? Sheesh, these things seem to be all over the place.
“Camp Robber” is a generic term, but are usually Gray, Canada or Blue Jays.
Tombstone is NOT in Maricopa County. It is in Cochise County. The Sheriff there is Larry Dever.
Thanks, I'll remember that.
Tombstone should have had from long ago , a surveyed right-of-way for the waterline. It probably was even deeded to the city. Even if not the city should be applying for the two as part of the project. The Feds could go pound owlburger if there was a right-of-way for the line. The line should have carried a “water right”. In many cases that right-of-way becomes part of the city. So many times I see these things get out of hand because the young fuzz-faced kids running the town don’t know the rules, don’t know how to look up the rules, and just keep playing the pressure hoping for a useful outcome. I’ve stopped several of these fights in their tracks locally simply by explaining the old rules to the diaper crowd.——the snivelers just shut up and slink off.
That was fun. The perfect way to get a teenage boy to enthusiastically rub out gophers.
I believe Spectracide and generic equivalent formulas also come in hose end sprayer bottles. That might be a bit easier to apply evenly than granules are.
Ultimely, this crime-in-the-making-under-the-color-of-law lays at the feet of Richard Nixon, a Republican.
Remember that as you consider your support for Romney.
Just bring in some barred owls. They EAT spotted owls, and are what endangered them to begin with.
First we had the illegal Mexican immigrants, now we have the illegal Mexican owl. Send them all back to where they belong and America can on with business. /sarc
So the hundreds of Mexicans (human beings = men, women & children) that have been killed due to the warped philosophies, beliefs and schemes of this administration aren’t even acknowledged by this bunch of heathens. But a freaking Mexican bird is more important than providing water for American citizens??!!! Someone needs to shoot the damn bird, fry it up, label it Fried Fast & Furious, and mail it to the White House.

My point is that it isn’t this administration.
It is President Richard Nixon (R), reaching out from the grave to punish us.
Remember that as you decide just how enthusiastically to support Romney
Would that explanation be by the old "shotgun barrel up the fourth-point-of-contact" method?
Over 99% of all species that have ever inhabited this planet are extinct.
