While Solicitor General Donald Verrilli, Jr. made the Obama administration’s case for the constitutionality of the individual mandate in the health-care law Tuesday, Supreme Court Justice Antonin Scalia interrupted, telling Verrilli, “we’re not stupid.”
Justice Elena Kagan, a former solicitor general appointed by President Obama to the high court, sided with Verilli in arguing that young people should be required by the federal government to purchase health insurance because eventually, others will subsidize their health care in the future.
Scalia shot back, arguing that young people will make the decision to buy health insurance eventually and do not need to be forced by the federal government to engage in commerce.

Why is Kagan even allowed to hear this case? How preposterous. We might as well allow 0 himself to make a ruling.
I hope Scalia qualified his remarks by stating that he wasn't speaking for Sotomayor.
To which Justice Elena Kagan jumped in with, "speak for yourself, Justice Scalia".

Its already been a pretty good day for the constitution with the acquittal of Hutaree militia members in Michigan. Now if the US supreme court follows suit it will be a very good day.

I'm not sure it really matters.They say that *Kennedy* is gonna be the swing vote and my understanding is that in the SCOTUS a tie vote is a vote to uphold so,if I'm correct,a 4-4 vote means OsamaObamaCare stays.
Should be the anthem for the 2012 election regardless of the nominee.
