Owner of north Houston convenience store uses deadly force on longtime customer(TX)

HOUSTON (KTRK) -- A store owner who says he was just protecting his north Houston business shot and killed a suspected thief overnight. That owner claims he had no other option but to use deadly force.

Tamika Hall came back to the New Land convenience store on West Little York near Andy Street, where her brother, the accused robber, was shot and killed. Hall says she needed answers.

"He didn't have to shoot him like that when he was behind the glass," she said.

But according to police, Hall's brother, 33-year-old Terrance Hall, showed up at the convenience store last night. Store owner Thom Vu says Hall was trying to shove his way through a back room.

Police say when Hall couldn't get inside, he climbed on top of an ATM and then jumped over the bullet-proof Plexiglas, falling behind the counter.

Witnesses say the scared store owner repeatedly told Hall to stop, but when he walked toward him, he says he fired.

"When he stood up, I just didn't have any choice," said Vu. "I was scared, too."

According to police, those who witnessed the shooting say Vu did everything possible not to shoot the suspect, who was also a longtime customer.

Halls sister admits her brother struggled with mental health issues. She says now she only wishes she had had been at this convenience store last night.

"I could have gone there to get him," she said. "If I was there, this would have never happened."

Climbing over the bullet proof glass, then advancing on an armed man who is telling you to stop seems rather threatening to me.

Sounds like he was no longer "behind the glass" when the shots were fired. Give Vu a medal and let's move on.

I thought protecting yourself in Texas was legal?

According to a source close to the investigation, Hall was shot in the arm at another location, but may have died from another medical complication.

The story just glosses over this, but evidently the perp had left the scene of one crime, where he had been shot, to enter the store to commit another crime, where he got shot again?

What else could it mean? Other than that the editor is a functional illiterate?

It's probably a legal procedure to protect the shooter from further prosecution at a later date. I would assume that if the grand jury finds it to be a justifiable homicide then the store owner cannot be criminally prosecuted later.

(Disclaimer: I'm not a lawyer or a Texan; just going by what I understand about the law as a CCW holder for over 20 years here in VA.)

Two possible scenarios: The shooting is in Houston proper where the prosecutor and jury pool is a bunch a racist blacks OR the shooting is in a suburb of Houston where the prosecutor wants to get the case no-billed which will help protect the store owner from civil action.

Exactly correct. Texas has a policy that all homicides go to a grand jury. This is actually a protection for the ordinary citizen, as it puts his case before fellow citizens rather than political prosecutors, and it does so in an expiditious manner, rather than waiting for months or years for a prosecutor to decide to prosecute or not.

From what I have seen, Texas grand juries to a pretty good job.
