Whitehouse is giving Holder and out by saying it was a common practice for new (?) can’t think of what they were called, but they all got to write memos to the attorney general which made them feel good, but those memos were never meant to go to the attorney general. So his point was that many memos were written.

Yep! And Holder said when ever that topic came up Kagan was sent out of the room! Now why would they do that, unless they knew way back then that she was going to be on the USSC?
