Sarah Palins family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the books author Joe McGinniss for knowingly publishing false statements in his book released last week, The Rogue, ABC News has learned.
The book was widely panned by critics for using unnamed sources to criticize Palin and her family. Tiemessen cites an email they have access to in which McGinniss writes that attorneys from Crown Publishing told him nothing I can cite other than my own reporting rises above the level of tawdry gossip. The proof is always just around the corner, but that is a corner nobody has been able to turn and that McGinniss ran out of time to sufficiently source the book.
A source close to the Palins tells ABC News that the Palins are fighting back and demanding answers from Random House.
Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip, the source said. The revealing email is key as evidence of this defamatory approach to politics through proxies.
Tiemessen writes in the letter that the email clearly describes the fact that Mr. McGinniss researched and investigated many false and scurrilous allegations, and concluded that there was absolutely no evidence anywhere backing these allegations.
Palins attorney writes that it is malicious for Crown to publish the book when it has proof McGinniss and Crown were fully aware the statements in the book were false, intended to be false, and were intended to harm.

In the delusional parallel universe McGinnis lives in, he and his publishers probably figured that this book would be
a useful roadblock to a Palin run for the Presidency. I don’t know what advance he got, but I’m sure most of it is already halfway down the drain, if the reviews are any indication-—this tome has already provided a fool’s gold standard for shabbily dishonest, hyper-partisan Sleaze Reportage—it’s as if a 2 page tabloid article was inflated to 100 times the length and given the cache of hardcovers and a dustjacket to buy it respectability. It’s obviously an embarrassment to all concerned if he didn’t get a rousing welcome on, of all places, “The View”. Palin should sue and let the lawyers handle it, but not before a coherent statement is made that makes the most of just what
the partisan intentions were. They obviously thought there was a big enough audience for this book to finance it, and they were wrong about that. They may lose even more, or McGinnis may well lose his advance if a lawsuit is successful and defamation is proved. But Palin should not personally let this take up her time and focus.

Those emails DESTROY McGinnis..Thank you Andrew Breitbart for once again uncovering the REAL truth!!! Those emails absolutely prove that McGinnis had NOTHING and made the whole thing up, all of those lies he concocted right out of his ass. Your absolutely right, a person cannot write a book based on lies KNOWING they are lies. McGinnis knew these were lies and printed them anyway because he knew he had nothing but wanted something to bring down the Palins..but instead of Sarah being harmed by this book it will be McGinnis and Random House who will be brought down by these lies
She’s threatening to sue and that’s what i believe is her intent - to threat which will make RH jump....pull the book off the shelves and prove that its a lie by their actions.

This disturbs me in a vague sort of way. She can run for President, or she can sue the crap out of this scumbag, but I don’t think she can do both simultaneously.
If this letter results in a fast withdrawal of the book and an apology — something they are probably already thinking about in the aftermath of that smoking gun email, well and good. But I really want her to run for President and not get bogged down in a legal battle at this stage.
The book is already dead-in-water and sinking fast. No need to give it more attention than it deserves by appearing to take it seriously.
As I posted before, I believe one of Governor Palin's motivations for stocking away the income was she was never going to be held financially hostage to anyone any more.

She has acquired sufficient financial resources, in the meantime, that she doesn't have to do both.
The lawyers can take care of business, while she takes care of business.
Which raises the question, how did Breitbart get those emails? And the bigger question, for the really paranoid, is why did McGinniss make such childish mistake? Why would he provide a textbook perfect solution to the NYT Malice problem for public figures? Is it a trap? Enquiring minds want to know ...

Indeed. In the last sentence of the letter, Tiemessen says:
Please do not hesitate to call if you have questions or concerns or if you wish to resolve this dispute.
The ball is in their court to propose a remedy that will alleviate the need to actually file suit. As in chess, "Check."
In addition to him being an ignoramus, Old Sloppy Joe wasn’t to bright when he admitted he wrote the email.
Well by someone else, that would mean that there were others who went after these jerks. This is the first time I can recall one of our guys hitting back hard over this stuff. The other book that should have been challenged is that Mark Halpren fantasy book he tried to peddle as the truth. Game Change.
Well, in order for a public figure to sue for libel, the person has to prove “actual malice.”
Normally, that’s very difficult to do, but not in this case.
I’m an Alaskan, and the other book about Alaska written by McGinnis, “Going to Extremes,” was pure crap. The scenes that supposedly took place in the towns where I lived seemed to be based on fantasy and rumor. I can either believe his words or my own eyes.
My fervent hope is that Palin’s lawyers chew him up and turn him into bait. Not that a fish with any respect would bite on it.
