The awful launch week for the over-hyped, expected bestseller The Rogue: Searching for the Real Sarah Palin, by controversial author Joe McGinniss, just got worse. Much worse.
After a week of universally scathing pans from the reflexively anti-Palin establishment media, McGinniss now faces the fight of his literary life: the accusation that he seems to have knowingly submitted a book to his publisher, Crown/Random House, that was filled with unproved tawdry gossip and rumors that lacked factual evidence.

What is the statute of limitations for this crime? Sarah doesn’t have to deal with it right now and should just let them know that she can and will, in her own time. Let them sweat it out.
He ought to be locked in a cell with Jeffrey MacDonald.
Defamation isn't a crime, it's a civil offense. Just meaning, McGinniss won't be charged by a grand jury or district attorney.
That said, statute of limitations is 2 years, for libel/slander, in Alaska.
I Agee! Breibart would not have released this if he didn’t think this was legit! Many MSM people are after to get him for all of the other scandals he broke, he’s not going to open himself up to the media sharks if he can’t back this up
I would not doubt that it is real. Breitbart got burned on the video that he had received that was out of context. My guess is he has vetted this pretty well.
Defamation isn’t. Libel is.
Joe McGuiness - Political Pornographer
Random House - his pimp.
He can just say it’s entertainment and not news.
It works for Fox...
Progressive fascists want desperately to destroy, or even damage, Sarah a little bit but they cannot. They know with certainty that her election as president will usher in an age of decency and goodness that they absolutely cannot tolerate. Their entire vile cultural is built on raw sewage, of which this book is merely the latest execrable pollution.
I was wondering what AlaskaWTF ment. I assumed it was either a blog or a newspaper that McGinniss didn’t like.
I'm speechless, but that's a prima facie admission of negligence, at the very least."
I luv Palin, best Gov I ever saw up here, and I know she would straighten this country out. I also remember hearing about the Hanson affair in late 90’s. I just figured the Palins were bigger people, had kids to raise, and worked their way through it for the better of their marriage. All those other stories are news to me and me thinks complete bull. Even if they were true, wouldn’t affect my opinion of her and wish she was still our governor.
Wilford Brimley was absolutely brilliant in AoM.
“You had a leak?!?! You call what’s goin’ on around here a LEAK? Boy, the last time there was a leak like this, Noah built hisself a BOAT.”
“You can keep your objection, counselor - this ain’t no court. The first amendment don’t say that, and the privilege don’t exist.”
Sarah may be limited by NYT v Sullivan, but Todd sure isn’t.
Based on you remark, I looked for "criminal libel" and was surprised!
At Least About 200 Criminal Libel/Slander Prosecutions in Virginia from 2001 to 2008 : Volokh Conspiracy.
This comment in that thread seems to indicate the damages, fine, whatever are minute; cheaper than some speeding tickets.
Anyway, interesting - thanks for challenging my blanket remark. I don't know if Alaska has criminal libel. According to footnote 41 in the article linked at Volokh, Alaska's Criminal Defamation statute was struck down in the case of Gottschalk v. State, 575 P.2d 289 (1978), and the law was also repealed.
Sue the crap out of him and the publisher.
I hadn't considered that, and thank you for the thought.
My impression is that he's fairly smart about authenticating material, but even very smart and careful people can be fooled.
