Clyburn: Obama Should Lift Debt Ceiling Like Lincoln Freed the Slaves

Rep. Jim Clyburn (D-S.C.) cited major civil rights victories as examples of successful presidential executive orders as evidence President Barack Obama should invoke the 14th Amendment to raise the debt ceiling if Congress fails to do so. “He could do that [an executive order] with a stroke of a pen. We have seen many big things done in history that way,” Clyburn said on MSNBC’s “Jansing & Co.”

“I was joking to my staff the other day: ‘Tell me the bill number for the Emancipation Proclamation.’ It was an executive order. We integrated the armed services by executive order. We integrated the public schools by executive order. Sometimes executives must order that things get done.”

Clyburn added, “If the president gets up to Aug. 2 without a piece of legislation, he shoud not allow this country to go into default. He should sign an executive order invoking the 14th Amendment and send that to all the governmental agencies for us to continue to pay our bills.”

Above is a video from Napolitano basically saying this is impossible but we’ve seen Congress do all sorts of legal and illegal tricks (remember the healthcare bill shenanigans?) so who knows how it will play out.

When elected officials publicly say something so contrary to the Constitution they should be tried for treason. He is violating his oath of office. He is an enemy of the Constitution and should be tried and if convicted, shot for treason.

The money flow is the life blood to a politician. The Conservative can survive but the Liberal is lost. The argument is that the Fed-Gov spends too much and the Dems are desperate to maintain that the Fed-Gov needs to keep spending at this current rate. Take this argument to the people.

Lincoln didn’t free any slaves, with the possible exception of his wife’s pair. the emacipation proclamation only referred to slaves in state in open rebellion - where Lincoln had no authority. slavery ended with teh 14th ammendment, passed AFTER his death.

I think there is a very good chance Obama will do this if there’s no agreement. He’s been itching to become Dictator ever since he was elected. This could be his big chance to burn down the Reichstag.

So the debt ceiling should be raised only in those states that have seceded from the union and are in armed conflict with Union troops? Maybe that's where the extra 7 states beyond the 50 I'm familiar with are.

Clyburn is ignorant of history. Here is a brief history from Wikipedia:

Lincoln issued the Proclamation under his authority as "Commander in Chief of the Army and Navy" under Article II, section 2 of the United States Constitution.[3] As such, he had the martial power to suspend civil law in those states which were in rebellion. He did not have Commander-in-Chief authority over the four slave-holding states that had not seceded: Missouri, Kentucky, Maryland and Delaware. The Emancipation Proclamation was never challenged in court. To ensure the abolition of slavery everywhere in the U.S., Lincoln pushed for passage of the Thirteenth Amendment. Congress passed it by the necessary 2/3 vote in February 1865 and it was ratified by the states by December 1865.[4]

Note that the Emancipation Proclamation was a war-time effort, and only applied to states that were in rebellion against the Union, and thus did not apply to all the slaveholding states.

As far as I know, there are currently no US states in open armed rebellion against the United States, and thus the President has no CIC justification to invoke.

Mr. Clyburn of South Carolina was made a "number three" leadership position styled Assistant Leader would be created for Clyburn. The exact responsibilities of Clyburn's assistant leader office remain unclear. Nancy Pelosi elevated the S.C. Negro to keep him and the Black Caucus happy...this quote pretty well sums up his work for America and South Carolina. "Clyburn has traveled all throughout the state of South Carolina honoring people who have made significant contributions to various causes." He is said to be very powerful..........for whom?
