Mystery prisoner has Utah jail authorities stumped

- A mystery man arrested on minor charges more than three weeks ago remains behind bars in Utah while law enforcement officials try to determine his true identity, which he refuses to reveal.

"This is really a strange case," said Lt. Dennis Harris with the Utah County Sheriff's Office. "He just doesn't want to be found."

The unidentified man, who has graying hair, a light beard and is believed to be in his 60's, was arrested on July 1 for trespassing in a parking garage.

He was booked into jail on three misdemeanor charges and has thwarted any chance of release, with or without bail, by refusing to identify himself.

If he were an escaped felon, there would be a criminal record to cross reference. I’m going with it is an aged D.B. Cooper.

Where does that code say anything about the peace officer then being able to hold a person indefinitely who declines to give their name for simple trespass in a parking garage? Unless this man was creating some commotion or destruction, he should have been advised to go on his way, imo.

Yeah, I’m guessing you’re right. Maybe he was trespassing in the parking garage in the first place to find a cool, shady, safe shelter for awhile. Jail might look like a pretty good place to some guys.

Statutory interpretation is not your strongest suit, I gather.

Maybe he is hiding his identity, because he’s an escaped felon?

- - - -
Then his fingerprints would have matched those on file. If his prints matched any of the databases (criminals, crimes, etc) then they would know who he is already.

I can’t remember. Is that a drawing of Cooper or the Zodiac Killer? Which ever one it is, he does very much resemble the drawing.

MrR, Could you tell me if this law is valid to keep the man in jail?

Perhaps - but it wasn't until fairly recently that the states bothered to share fingerprints of their convicted criminal element. For decades, the prints used in one state on a murder case; were never shared with other states - so a person could murder and simply hop state to state; and keep ahead of the law. Today, the CURRENT sets of prints are on a national database - but what about criminals from the early 80's and before?

They obviously took his fingerprints when he was booked, and they don't match anything, so why are they still holding him just because he wants to remain off the grid?

Either charge him as John Doe #xxxxx, or let him go.

Of course, if he's refusing to ID himself because they won't let him go until he does, then he's putting the joke on them. He's got three hots and a cot, rather than a parking garage and a trash can.
