Police officers crushed a man’s phone and held a gun to his head in an effort to destroy a recording he made of a fatal shootout, he claims.

Narces Benoit saw the officers shoot dead Raymond Herisse, 22, in Miami Beach, Florida, last week after the suspect sped off and drove recklessly . Mr Benoit was nearby with girlfriend Ericka Davis when one of the officers allegedly put a gun to his head, handcuffed him and smashed his phone.

I’m beginning to think it will take something like that to end these kind of police outrages and abuses

The only way it will stop is CRIMINAL prosecution of the individual thugs/cops involved. (And we all know how likely that is.)

Unfortunately for those many (3 actually) states, getting video hosted anonymously from offshore sites isn't difficult to do, and those laws are made in clear defiance of the constitution.

“Miami Beach Police Say They Found Gun In Car Of Man They Killed” by Carlos Miller

Miami Beach police say they found a gun in the car of the man they shot more than 100 times on Memorial Day - two-and-a-hallf days after the actual shooting.

Chief Carlos Noriega said the gun was out of sight, which is why police did not find it until 7 p.m. Wednesday even though the shooting occurred at 4 a.m. Monday.

Perhaps police will find spent shell casings by this weekend.

Discovery of the gun was described as “great news” by Noriega, who said they still haven’t determined if it had been fired or not.

Interesting video. On it they said the police chief "wasn't aware" of any other cell phones that had been taken like Benoit's was. But then there's this from the accompanying article: "Television station Local 10 said police would not tell them why one of its cameras was confiscated on the same morning." Frightening.

You were dead on. The actual name of he law isn’t as important as the law being codified, and the punishment being directly related to the severity of the crime.
