TUCSON (KGUN9-TV) - The Pima County Medical Examiner has released the official autopsy report on the death of Jose Guerena, the 26-year-old former U.S. Marine who was shot to death in a SWAT raid on May 5. The report confirms what a spokesman previously said to KGUN9 News by phone, that Guerena's body had 22 bullet entrance wounds. The report also shows that Guerena had many exit wounds as well. There were no drugs in his system.
The autopsy lists the manner of death as "homicide" caused by "multiple gunshot wounds." In the case of a Medical Examiner's report, this is a legal term that simply means the victim died at the hands of another human being. The term has no bearing on whether the shooting was justified. Separate investigations into that question are underway.
The report also notes that the body shows "no evidence of medical intervention."
It goes on to note in detail the entrance location and trajectory of each wound, most of which were on the victim's extremities.
The medical examiner found, in order:
one wound to the head, which the report describes as a graze;
one wound to the right upper chest;
one to the right lower chest;
one to the left upper abdomen;
three to the right upper arm;
one to the right elbow;
one to the right hand;
one to the left upper arm;
one to the left elbow;
one to the left forearm;
one to the left hand;
two to the right thigh;
one to the right calf,
one to the right foot;
four to the left thigh;
and one to the left foot.

IMPO criminal negligence form the search warrant affidavit to serving to failure to get medical assistance....the sheriffs violated their own rules for use of deadly force..

Arrested in 2009, no charges, no conviction. But now he is dead and a SWAT team looks pretty foolish how they bumbled it.
And Sheriff Dip Stick again shows how totally incompetent he is. (Remember his blaming the Tea Party for the shooting of Congresswoman Gillfords? And it turned out that the shooter was a leftie and known by Dupnik to have threatened others. In spite of that he covered for the kid because he worked near the kid’s mom.)
Anybody still loading with frangibles for home defense needs to reconsider what the target is likely to be. Whether it is the local S.W.A.T. or a group of thugs dressed like the local S.W.A.T., the target is probably going to be armored in some fashion. So, shoot first and shoot fast, the odds are that if local S.W.A.T. kicks in your door, you are going to die regardless.
It’s fun to see the badgelickers intentionally leave out critical information that doesn’t make the “perp” look like some kind of comic book bad guy.

They updated the story after I posted, so it’s a little bit different. The reporter called the Medical Examiner to clarify about what were the fatal shots. He narrowed it down to two in particular. I was reading the article to hubby via phone since he is at work. His questions were all about what was the position of the body when it was found. It sounds like a man who was trying to get away, but that’s based on descriptions we’ve read. What was the trajectory?
For all those who were saying that the wife lied and/or exaggerated about Jose being shot 60 times, maybe they need to read this report. “The combined number of entrance and exit wounds listed in the report numbers 96.” In seven seconds. Murder.
Murderers.
How do you let a man, any man, even a very bad many lie on the floor with no medical intervention?
There is something going on with this case and it ain’t right.

Yes, it does. And considering how they shot a man lying on the ground. The magic bullet going from left thigh to abdomen to kidney makes me think he was down. But what do I know?
A conversation picked up during the raid,
“.....ever shoot anyone?, son?”....”Why, no sir, I haven’t, I’m new to the squad.”......”Well, here’s your chance. Go in there and put a few rounds in him. Good training for you”......(sound of gun fire).....”That was great! Can I do a few more, sir?”....”Naw, one clip is enough”......
Sounds like that's what happened but it doesn't necessarily mean they did so intentionally. Could be more on the side of incompetence, firing dozens of rounds blindly at a target they can barely or not at all see, without knowing he's already down. Not allowing medics in for an hour and a quarter, that's another matter.
I was making the point that while they almost certainly shot him while he was down, that doesn't necessarily imply they knew that's what they were doing when they did it. OTOH, if so, that simply moves the problem from malice to incompetence, which isn't a big improvement.
I doubt it. If that were the case, why wait an hour and a quarter to allow medics access, which could be critiqued later?
He was released without being charged. The bond money was returned to his wife.
That post was the cheapest of cheap shots.
You cannot commit a criminal act under color of law. The presumption of moral behavior is not excusable by bad policy. The Nuremberg Trials proved it. Cops can’t kill just because they feel threatened, anymore than a former Marine can kill because he feels threatened living in a bad neighborhood.
