Alabama Passes Mandatory E-Verify & Immigration Enforcement Bill
Friday, June 3, 2011, 1:25 PM EDT
An Alabama House and Senate conference committee agreed on a new bill, which both chambers have already passed, that requires the use of E-Verify by all businesses in the state and includes several immigration enforcement provisions. Should Gov. Robert Bentley sign the bill into law, it would become one of the largest state crackdowns on illegal immigration in the country.
The bill requires all businesses, public and private, to begin using E-Verify effective April 1, 2012. Businesses that do not comply face suspension of its business license and loss of employee expensing for state income tax purposes. All state and local businesses must be in compliance by Jan. 1, 2012 or face loss of business license and contract.

Not going to happen...to those who are crooks and thiefs laws are only a guidline for them to see how far away from that line they can operate without actually breaking those laws...loopholes come to mind.
Additionally, we have a Pres. who now bypasses our constititutional laws...as a leader he sets the tome of how people look at the laws of our land...so no brainer that companies and illegals will surely find a way to work around E-Verify as well.
The only businesses that will thrive are those providing flse documentation etc. in order to bypass the E-verify. I can see bribes etc. esculating as people more and more find themself in economic straits.
The burden and responsibility lies at the local level with the businessman. The tools are there. Even if our government was doing its job right now, there are millions here now who don’t belong here. Making sure an American gets the job is up to the businessman, who should not just try to walk away from that responsibility.
Give me a break Doug!
The boders are open. Free health care. Free education. The ability to drive on our streets, live in the open buy houses and property with no fear of deportation????? Are you kidding me? I will be willing to make an effort when society makes a real effort. Right now it’s just a bunch of b.s.
This village sucks. It is unbelievable that it could be so bad somewhere else that they would want to come here.
But Janet Napolitano told the governor of South Carolina that E-Verify can't be used to check immigration status.

So, we have the court approving the law. And the Department of Homeland Security making it impossible to enforce.
I hope I gave no indication that I supported throwing up our hands and giving up.
Certainly, we need to keep the pressure on. Through he courts. Through the states. Through the ballot box. And through are own media.
See my post #96. Check out the link. If you read what I wrote, you will notice that it is the I-9 form that has the photo and is used to match against what is in E-verify.
You just don't seem to understand what E-Verify is and how it operates. Check out the link below and perhaps you will gain some appreciation about what the program does and how effective it has been. There is a reason why the open borders, pro-amnesty types have fought this program tooth and nail and spent huge amounts in the courts trying to stop its implementation.
With all of those GOP pickups in the off-year elections, NOW is the time to do this. If you have a GOP governor, git ‘er done.
I read it. Good article.
If you read what I wrote, you will notice that it is the I-9 form that has the photo and is used to match against what is in E-verify.
Got it, I-9 has a place for a photo. But you didn't answer my question: Where does e-verify get its photos to compare against the I-9s? I am assuming that e-verify does not have photos for everyone; correct me if I am wrong.
Re SC: I have read the transcript. There appears to be some confusion by the governor on the issue. E-Verify is a voluntary program that is in operation throughout the country, including South Carolina. DHS can't stop the program from operating in SC. The issue appears to be a dispute between that state and DHS about disclosure of information on the program by SC businesses to the government of SC.
Haley: "I'm not asking for numbers or identifying that would compromise these people. What we would are saying is show us the e-verify summary for last name only if you tell me you hired Douglas Walker and Smith, show me the summary sheet that says you e-verified them."
It would be interesting to learn what SC would do with that information. I have been involved with trying to get E-Verify passed in VA similar to the AZ law. So far, we have been able to make E-Verify mandatory for all state agencies, but we have been unable to pass mandatory use of E-Verify by all businesses in the state, i.e., if there is non-compliance, business licenses would be suspended. Under the AZ law, every citizen has standing reporting businesses that aren't in compliance. But I am not aware in the case of AZ of requiring businesses to submit compliance reports to the state. I would have to do further research to see what kind of E-Verify legislation has been passed in SC.
But the bottom line is that E-Verify has not been stopped in SC or anywhere else in the country by DHS. In fact, E-Verify is mandatory for all federal contractors. There could be privacy issues involved in releasing the kind of data SC wants from businesses using E-Verify.
I do understand...but that article says nothing whatsoever about how to prevent false documentations, which employers will be responsible for in providing that information to do the verification for E-Verify.
I suggest you go to the following link to get yourself up to speed on E-Verify and how it works: E-Verify
There are databases in SS and USCIS that are used to verify the information submitted by the employer and employee thur E-Verify and the I-9s. 98% of the illegals who steal SSNs use their own names. Obviously there would be a mismatch if the SSN is submitted using a different name. There is also data in the DHS files.
E-Verify works by comparing information entered from an employee's Form I-9 to:
455 million Social Security Administration (SSA) records80 million U.S. Department of Homeland Security recordsU.S. Department of Homeland Security databases contain records about employment-based visas, immigration and naturalization status, and U.S. passport issuance, which allow E-Verify to compare information against a wide variety of sources.
Employees have the right to present ANY acceptable documentation to complete Form I-9. Employers may NOT require an employee to present a specific document. Employers must accept the documents the new employee chooses to present as long as they APPEARTO BE GENUINE to be genuine and relate to the person presenting them. Otherwise, employers may violate federal law prohibiting discrimination in the verification process.

Thanks for the explanation.
There is a problem with illegals in almost EVERY state 9 maybe not Hawaii and Alaska, maybe)! It isn’t just about illegal Mexicans. Terrorists could easily enter here undetected to do their evil. Once in, they spread throughout the U.S.
No time like the present to grow a pair.
This is the reason why the I-9 should not be THE document for verifying that someone is legal and able to work. There is widespread fraud despite the Chamber of Commerce saying it is sufficient. It is the reason why E-Verify should be made mandatory nationwide as Lamar Smith is trying to do.
I fully support this bill. I think we need to crack down on illegal immigration. So everybody who was calling me a “libertarian” in a previous thread can read that statement.
