Guerena family attorney responds to SWAT lawyer (Wants Pima Sheriff Dupnik to release reports)

TUCSON (KGUN9-TV) - Guerena family attorney Christopher Scileppi said he's working with a dead Marine's honor, and a family's grief.  He wants to see proof to back up attorney Mike Storie's account of the SWAT raid that left Jose Guerena dead.

Storie held a news conference Thursday and released several new details about the May 5 raid at the Guerena house that have been kept private until now.  He detailed why SWAT was serving a search warrant and what they found, and gave a reason for why paramedics waiting at the scene were not allowed inside the house to treat Guerena after he was shot.  Storie told KGUN9 that a SWAT robot was sent into the home to examine the threat level, and by then, it was too late for Guerena.  Scileppi has continued to argue that Guerena thought he was defending his home from an invasion when SWAT broke down his door.

"The SWAT team has lawyered up and all Mr. Storie, their lawyer, did today was attempt to discredit a Marine who served two tours abroad and put out statements unsupported by facts," Scileppi told KGUN9 News.  Now he's calling for Storie and Sheriff Clarence Dupnik to release the reports and documents about the raid.

Scileppi disputed Storie's account that Guerena ducked or fell into a room where SWAT couldn't see him and be sure he was no longer a threat, and that's why they didn't order medical care for him.  Scileppi says blood stains in the house make it look like Guerena went down in the hall where SWAT could see him easily.

If that’s the wrong house, every officer on the scene deserves a life in prison jail sentence. The ones with any sense of honor should assume room temperature on their own accord.

Soooooo... the warrants are sealed, and the cops aren't releasing any information. But somehow, the cops' lawyer gets to selectively release their side of the story as they make it up.

This is stinking worse and worse by the minute.

(BTW, just where ARE those badgelickers? I haven't seen them lately.)

I don’t know if that report was true or not, but there was never any reason to turn loose 71 rounds of rifle ammo in that house. I wonder what would have happened if the Marine had loosed something with a little heft, like a 300 gr projectile at around 2500 fps. With 4400 foot pounds of push right off the muzzle, those fellows would have gone down like bowling pins. Of course he would still be dead, but could have bled out with a little more satisfaction.

I heard today that Tera Servatius, an investigative journalist from WBTV in Charlotte, NC reported that the raid was on the wrong house.

I read in an article that the victim had only been in the house for two months, and that the warrant was for the address- not for any named individual.

I'm thinking there are two possibilities here. (1) The cops were acting on old information, in which this was incompetence; or (2) This was what it looks like- a hit, a MURDER, a CRIMINAL act.

Only piece of information I need to know that this was just “Cowboys and Civilians” being played with big boy toys. All of them need to go down and very hard.

This story makes me sick to my stomach. even worse - the fact that Dupnick is now defending this makes me so enraged you have no idea.

stories like this make me almost feel like a liberal on civil liberties issues.

Get rid of SWAT, patriot ACT, etc. Enough is enough.

If this were a family member of mine, Iwould personally hunt down each one of these thugs with badges and > > .

If anyone likes, check with your local police department or city council on what their policy is regarding the use of deadly force. You will find in most cases that once an officer discharges their weapon, they are to continue firing until the magazine is empty. Dead is cheaper to settle than paralyzed in a wheel chair and pissing in a bag for the rest of your life. Dead is in the few hundred thousand dollar range on average and wounded needing living assistance for another fifty years is in the millions.

Review your community's standards and you'll be surprized. Once a cop gun is fired, they want the Sallie to be dead.

This was the same guy who couldn't talk to the press enough about the Gabby Giffords shooting. Going on cable talking about the heated political rhetoric being responsible for the shooting.

He sure had a lot say then. And not knowing what he was talking about sure didn't stop him either.

Peter principle met decades ago. I don’t mean to sound unglued, but in some cases of arrogance with a badge, more people will suffer at the hand and mouth of this guy if good people do nothing. Why the city / county / state government has not stepped in and removed the guy after the Gabby fiasco I have no idea? The sheriff makes that Moose guy from the DC shooter spree look like a rocket scientist.

I've never understood the outrage over how many bullets cops fire at someone. Like there is some sort of sliding rounds fired metric to be applied?

People are strange that and other ways.

He was not dead when he hit the floor. In other articles his wife saw him on the floor and heard him moaning. He was dying, he was not dead instantly.
