TUCSON, Ariz. (KGUN9-TV) 9-1-1 recordings from a deadly SWAT shooting reveal some tense moments:
911: Is law enforcement at your house, ma'am? Is law enforcement at your house? (Are they) inside or outside your residence?
Guerena: They are outside, but they came inside! They were inside. They were (inaudible) going to shoot me. And, I put my kid in front of me. They were going to hit me!
911: Ok, I need you to calm down.
Fear and panic from the wife of decorated Marine Jose Guerena's. Vanessa Guerena called 9-1-1 the morning of May 5th, the day SWAT busted through her family's front door; unloading 71-rounds the Marine's way, in just 7-seconds.
SWAT said it did not expect Jose's wife and young son to be home. But, it also did not expect the Marine to point a semi-automatic weapon their way; saying, according to authorities, "I've got something for you!"
Moments later, the 26-year-old Marine was gasping for his last breaths of air
911: Where's he ...where's your husband at right now?
Guerena: He's on the floor!
911: Is he inside the house?
Guerena: Yes, he's on the floor! (crying) Can you please hurry up?! Somebody...
911: It's very hard for me to understand you, ok. When you get hysterical, ok?
Guerena: Can you please send somebody, please?
Help did arrive; and, reports show a Lifeline helicopter was put on standby. But, a KGUN9 investigation uncovered it took an hour-and-fourteen-minutes before SWAT let paramedics work on Guerena.
At one point, you even hear 9-1-1 operators asking wife Vanessa to provide CPR to her own husband:
Guerena: I can't. I can't. I can't do that. There's a bunch of people outside of my house. I don't know what the heck is happening.

It’s almost like they wanted to report that he said “say hello to my little friend” but someone thought that would be too on the nose. Lets see if they leak that he had coke smeared all over his face as well.

It’s getting ridiculous the way the police are getting away wit raids on people’s homes. They claim they didn’t know his wife and child were there. What did they know? Where did they expect them to be? Don’t they have a lookout on the homes they get ready to raid?
No way they could get off the first shot on a marine who had an intention to shoot them.Definitely not 71 of them.
What are the rules of engagement? When a shot is fired everybody start shooting? It’s a miracle anyone survived.
I don’t think their original intention was for him to die, but it does seem probable that they weren’t going to let him live once they discovered their mistake.
They should never be sending in SWAT anyway, unless they know for a fact that they know they are dealing with a gang.
They could have probably solved this with a single guy, in armour and a knock on the door.
If the guy inside shoots or something, then they can send in SWAT.

In a way they have to justify SWATs existence cant have these well trained people just sitting around. I personally think there is absolutely no justification for having these people in this country at all none Cops yes but SWAT no.
First they justified it by saying they will only be used for this now look they do everything from serving warrants to anything needed.
For now that is nothing more than your assertion.
This Marine was dead before he had the chance to realize what was even happening, murdered by a bunch of out of control Gestapo.
He had time to tell his wife to take cover and for him to get his weapon and take a position.
It's not a matter of ROE so much as human reactions. It's called "sympathetic firing." Once ANYBODY fires a shot, most cops will empty a magazine. The Diallo case in NYC was the first famous example of this. He was reaching for ID to comply with a police order, another cop fired, and all the cops unloaded.
That is what SWAT does and should do.
However, they knew that they weren’t dealing with a big name hoodlum and that, if he was involved in criminal activities at all that he was fairly nonviolent and very smalltime.
In other words, the people who screwed this up were the ones that thought SWAT was the proper use of resources on this case.
That is who should be losing their heads over this one.
It's likely the Affiants lied to get the warrant and they're trying to manufacture real probable cause.
IF it is found the affiants lied they should be prosecuted for Murder 1.
How could they possibly have legit evidence for the warrant when the deceased was not involved in the drug trade?
Did anybody beside the cops even SEE him holding the rifle?
He could have been putting it on the ground when he was shot, for all we know.
As you say, it’s just an assertion, the same as the assertion that he was murdered by out-of-control Jack Booted Thugs. Or your assertion that he was not.
Absolutely. Most big cities, that would have SWAT, are within easy access that they can be called upon when the need is there.
City Manager to Chief of Police, Last Year:
“I see here that we spent 4.5 million dollars on the SWAT team last year, and it was only called out 15 times! I think we can cut that budget.”
Result: Next year the SWAT Team will be called out 360 times for routine police work.
That is certainly part of the thinking.
Now, instead of trying to justify why they have only called it out 15 times, they will now have to justify why it was needed for a situation of a retired marine who has a one shotgun and a nonviolent record.
Supposedly the safety on his rifle was in the ‘on’ position when the MIBs SWATted him.
I think it is becoming more apparent that our SWAT teams should now be called Death Squads as our country descends in Third Worldness.
